Regulations on Receiving and Sending Letters, and Receiving Gifts for Students at Reformatory Schools

The Ministry of Public Security has just issued Circular No. 43/2015/TT-BCA providing regulations on visitation; receipt and sending of letters, money, gifts; and telephone communication for students at reformatory schools and inmates at mandatory education institutions.

At Article 8 of Circular 43/2015/TT-BCA stipulates the reception and sending of letters; receiving gifts for students of reformatory schools and detainees at compulsory education institutions, specifically as follows:

Firstly, reception and sending of letters

- Students and detainees can receive letters during visitation. The letters of students and detainees must be thoroughly inspected by officials before being brought into the reformatory schools or compulsory education institutions;

- Students and detainees are allowed to send letters. Detainees can send 2 letters each month. In cases where students or detainees are seriously ill or need to exercise their rights and obligations under the law or other necessary cases, they are allowed to send telegrams. The Principal of the reformatory school or the Director of the compulsory education institution must inspect and censor the letters and telegrams sent and received by students and detainees.

Secondly, receiving gifts

- Students and detainees can receive gifts (excluding alcohol, beer, cigarettes, stimulants, prohibited items, and cultural products) during visitation. Gifts for students and detainees must be thoroughly inspected by officials before being brought into the reformatory schools or compulsory education institutions. In cases where relatives of students and detainees purchase goods at the reformatory school canteens or compulsory education institution canteens for students and detainees, the canteen sales staff must inspect and pack the goods thoroughly before delivery, ensuring no prohibited items are hidden to be brought into the reformatory schools or compulsory education institutions;

- Students and detainees can receive parcels and packages twice a month by post, not exceeding 7 kilograms (kg) each time, or not exceeding 14 kilograms (kg) if sent once. Students and detainees who comply well with the regulations of the reformatory schools or compulsory education institutions, achieve good performance in labor and study, or have meritorious deeds can receive an additional parcel or package not exceeding 5 kilograms (kg). The reformatory schools or compulsory education institutions are responsible for inspecting the parcels and packages sent by post for students and detainees;

- Students and detainees are not allowed to receive or use any goods, food, or dishes that do not ensure hygiene and food safety, and any prohibited items according to legal regulations from being brought into the reformatory schools or compulsory education institutions.

Note: The reformatory schools or compulsory education institutions will guide students and detainees to notify their relatives about the goods, items, and cultural products they are not allowed to receive and provide the address where students and detainees are serving their decisions (team, unit, sub-unit, sub-division) to ensure their relatives can send letters and gifts to the correct address.
