Regulations for Professional Soldiers Demobilized from December 30, 2016

On November 11, 2016, the Government of Vietnam promulgated Decree 151/2016/ND-CP specifying details and providing guidance on the implementation of certain provisions regarding policies of the Law on Professional Servicemen, Defense Workers and Public Employees.

At Article 4 of Decree 151/2016/ND-CP stipulates policies for professional soldiers who are discharged under points a, c clause 3 Article 40 of the Law on Professional Soldiers, Defense Workers, and Defense Officials, as follows:

- Be provided with a job creation allowance equivalent to six months' statutory pay rate as regulated by the Government of Vietnam at the time of discharge; be supported with vocational training or job placement through employment service organizations of ministries and central authorities, unions, localities and other socio-economic organizations.

- Be entitled to a one-time discharge allowance, with each year of service receiving an allowance equal to one month's salary of the month immediately preceding discharge.

- Be entitled to one-time social insurance benefits or preservation of social insurance participation period according to the current legal provisions on social insurance.

- Be given preferential points in examination or recruitment of officials according to the provisions at Article 5 Decree 24/2010/ND-CP dated March 15, 2010, of the Government of Vietnam on recruitment, use, and management of officials; or be given priority when determining successful candidates in public employee recruitment examinations as per clause 2 Article 10 Decree 29/2012/ND-CP dated April 12, 2012, of the Government of Vietnam on recruitment, use, and management of public employees.
