Registration of Birth for Children Born Abroad Residing in Vietnam

My husband and I are currently living in the United States, and we want our child to live with their grandparents in Vietnam. I am wondering if I can register my child's birth in Vietnam or not. If possible, what are the procedures?

Children born abroad who have not yet registered their birth and residence in Vietnam, if they have a father or mother, or one of the two who is a Vietnamese citizen, the District-level People's Committee of the place of residence of the father or mother shall carry out the birth registration (based on Clause 2, Article 35 of the Civil Status Law 2014).

The person requesting the birth registration needs to present documents proving the child's residence in Vietnam and submit the following documents (according to Clause 2, Article 29 of Decree 123/2015/ND-CP):

- Declaration form as per the prescribed format;- Birth certificate or other documents issued by a competent foreign authority confirming the child was born abroad and, if applicable, mother-child relationship;- Written agreement of the parents on the choice of nationality for the child in cases where the child has one parent who is a Vietnamese citizen and the other is a foreign citizen. This written agreement must be confirmed by a competent state authority of the country of which the foreign parent is a citizen, confirming that the choice of nationality for the child complies with the legal provisions of that country (duly legalized and translated into Vietnamese).

On the same day of receiving the request, the Justice Department will check the dossier. If the dossier is complete, accurate, and conforms to legal provisions, the civil status officer will record the birth registration details into the Civil Status Register.

The birth registration details as prescribed in Article 14 of this Law include:

- Information of the person being registered: Last name, middle name, and first name; gender; date, month, year of birth; place of birth; native place; ethnicity; nationality;- Information of the father and mother of the person being registered: Last name, middle name, and first name; year of birth; ethnicity; nationality; place of residence;- Personal identification number of the person being registered (in cases where the child has foreign nationality, this content is not recorded).

The civil status officer and the person registering the birth shall sign in the Civil Status Register. The Justice Department will report to the Chairman of the District-level People's Committee to issue a Birth Certificate to the person being registered.
