Reconstruct the scene of a waterway traffic accident if the original scene is disturbed in Vietnam

On June 19, 2020, the Ministry of Public Security issued Circular 64/2020/TT-BCA stipulating the procedures for investigating and handling inland waterway traffic accidents by the Traffic Police force in Vietnam.

In Article 16 of Circular 64/2020/TT-BCA, it is stipulated that during the investigation and verification of traffic accidents, if there are grounds to determine that the scene has been tampered with, falsified, or deemed necessary for the investigation, verification, and resolution of the traffic accident, the scene of the traffic accident shall be reconstructed. The reconstruction of the scene of domestic waterway traffic accidents in Vietnam will proceed as follows:

- If there are grounds to determine that the scene has been tampered with, falsified, or deemed necessary for the investigation, verification, and resolution of the traffic accident, the scene of the traffic accident shall be reconstructed. The reconstruction must have a plan and a decision from an authorized person.

- Before reconstructing the scene of the traffic accident, the appropriate time, weather, and means must be selected similar to when the traffic accident occurred. During the reconstruction, preventive measures against damage must be in place and should not obstruct or cause traffic congestion.

- The content of the scene reconstruction must reestablish the positions of the victims, evidence, vehicles, and traces left at the scene, review the circumstances, behaviors, and details when the traffic accident occurred; measure and redraw the scene map; take photos for comparison.

- At the end of the scene reconstruction, a report on the reconstructed scene examination must be made, and a map of the reconstructed scene must be drawn; participants in the reconstruction must sign and clearly state their names in the report and on the map.

More details can be found in Circular 64/2020/TT-BCA, which comes into effect in Vietnam from January 01, 2021.
