Provisions on the Procedures and Steps for Disciplinary Actions Against Militia and Self-Defense Forces from August 5, 2020

On June 19, 2020, the Ministry of National Defense issued Circular 75/2020/TT-BQP stipulating the application of disciplinary forms, procedures, statutes of limitations, time limits, and authority for handling disciplinary actions for self-defense militia.

According to the provisions of Article 31 Circular 75/2020/TT-BQP, the order, and procedures for handling discipline for the Militia and Self-Defense Force are as follows:

  1. The violator must conduct a written self-review before the collective of the agency or unit and self-assess the disciplinary form. In the event the violator is absent and does not self-review, the agency or unit shall conduct verification at the residence of the violator's family or local area and make a record of the violator's absence. The verification record shall be announced to the agency or unit and has the same value as the violator's self-review.

  2. The agency or unit directly managing the violator shall hold a meeting to review the violations and propose a disciplinary form. In the event the violator is absent, based on the verification record, the violation dossier, and the disciplinary behavior of the violator, the agency or unit shall organize a review meeting and propose a disciplinary form.

  3. The direct commander or authorized person shall verify and meet the violator for the violator to present their opinions. In the event the violator is absent, the commander shall, based on the verification record and violation dossier, conclude the violation behavior and disciplinary form.

  4. Conclusion on the violation behavior.

  5. Report to the Party Committee with competent authority for consideration and approval (if any).

  6. Issue a decision or request competent authority to issue a decision to handle the discipline according to the decentralized authority.

  7. Announce the disciplinary decision, report to higher authorities, and archive the dossier at the unit, agency, or organization.
