Recently, the Government of Vietnam issued Decree 79/2020/ND-CP stipulating policies in constructing and mobilizing reserve forces.
Application for accident assessment and allowance for reserve military personnel (illustrative image)
The application for accident assessment and compensation; the application for death allowance due to accident or illness, accidental risk for reserve military personnel is stipulated by Decree 79/2020/ND-CP as follows:
First, the application for accident assessment:
- Letter of introduction from the unit directly training the reserve mobilization regiment-level or reserve officer training facility (direct training unit) (01 original);- Hospital discharge papers (01 original or copy) or medical file excerpts;- Injury certificate (01 copy) from the medical facility (where the reserve military personnel was treated);- Accident investigation report by the direct training unit (01 original).
Second, the application for accident allowance:
- Accident investigation report by the direct training unit (01 original);- Hospital discharge papers (01 original or copy) or medical file excerpts, or a copy of the injury certificate from the medical facility (where the reserve military personnel was treated);- Training concentration order or decision to call for reserve officer training from the competent authority (01 copy);- Injury assessment report by the Provincial or equivalent level Medical Examination Board (02 originals);- Allowance decision from the direct training unit (02 originals).
In case of traffic accidents, an additional traffic accident report from the police or the Ministry of National Defense's Criminal Investigation Agency is required (01 original or copy).
Third, the application for death allowance due to accident or illness, accidental risk:
- Accident or illness, accidental risk investigation report by the direct training unit (01 original);- Death notice or death certificate (01 copy) or death record extract or copy of the court's legally effective declaration of death decision (in case of missing persons);- Training concentration order or decision to call for reserve officer training from the competent authority (01 copy);- Allowance decision from the direct training unit (02 originals).
The entire dossier is prepared in 02 sets, kept at: The direct training unit (01 set); individual reserve military personnel, reserve officer trainees, or family of the deceased person (01 set).
Regarding responsibilities and procedures for resolving benefits
First, in case of resolving accident allowance
The individual submits directly or sends via post the hospital discharge papers or medical file excerpts; injury certificate from the medical facility (where the reserve military personnel was treated) to the direct training unit to prepare the referral dossier for assessment; upon receiving the notification from the direct training unit, the individual goes directly to the Medical Examination Board for assessment.
The direct training unit sends 01 dossier set as per Point a, Clause 1 of this Article to the Provincial or equivalent level Medical Examination Board for assessment; upon receiving the assessment schedule from the Medical Examination Board, the unit will notify the individual for assessment.
The Medical Examination Board receives the assessment dossier, notifies the direct training unit of the assessment schedule; within 05 working days after the assessment, completes the Assessment Report and sends it together with the dossier to the direct training unit.
Within 10 working days from the date of receiving the dossier, the Assessment Report from the Medical Examination Board, the direct training unit completes the dossier, decides the accident allowance per Point b, Clause 1 of this Article, and notifies the individual to receive the allowance directly or via bank transfer.
Second, in case of resolving death allowance due to accident or illness, accidental risk:
The family member of the deceased submits directly or sends via post the death notice or death certificate of the individual or the death record extract or copy of the legally effective death declaration decision of the court (in case of missing persons) to the direct training unit.
Within 10 working days from the date of receiving a valid dossier as per the regulations, the direct training unit is responsible for verifying, completing the dossier, deciding the allowance per Point c, Clause 1 of this Article, and notifying the family to receive it directly or via bank transfer.
