Prohibited Acts under the Law on Fire Prevention and Fighting?

Article 13 of the Law on Fire Prevention and Fighting dated June 29, 2001 (effective from October 4, 2001) and Clause 8, Article 1 of the Law amending and supplementing a number of articles of the Law on Fire Prevention and Fighting dated November 22, 2013 (effective from July 1, 2014) clearly stipulates prohibited acts, specifically as follows.

  1. Intentionally causing fire or explosion to harm human life and health; causing damage to the property of the State, agencies, organizations, and individuals; adversely affecting the environment, security, and public order.

  2. Obstructing fire prevention and firefighting activities; resisting persons performing fire prevention and firefighting duties.

  3. Exploiting fire prevention and firefighting to infringe on human life and health; infringing on the property of the State, agencies, organizations, and individuals.

  4. Reporting false fire alarms.

  5. Not reporting a fire when the conditions for reporting are met; delaying the fire report.

  6. Illegally producing, storing, transporting, using, or trading substances hazardous to fire and explosion.

  7. Illegally bringing flammable and explosive goods and substances into crowded places.

  8. Constructing works that are hazardous to fire and explosion, high-rise buildings, and commercial centers without approved designs for fire prevention and firefighting; accepting and putting into use works hazardous to fire and explosion, high-rise buildings, and commercial centers without meeting safety requirements for fire prevention and firefighting.

  9. Appropriating, destroying, damaging, arbitrarily altering, moving, or obscuring fire prevention and firefighting equipment and devices, signage, and directions; obstructing emergency exits.

  10. Other actions violating the provisions of law on fire prevention and firefighting.

Persons who violate these provisions of this Law shall, depending on the nature and extent of the violation, be subject to administrative penalties or criminal prosecution; if causing damage, they must compensate according to the provisions of law.
