On April 12, 2024, the Ministry of Defense of Vietnam issued Decision 1388/QD-BQP on the announcement of new and annulled administrative procedures related to medical examination and treatment under the Ministry of Defense.

Procedures for issuance of a practice of medicine in the military in Vietnam

(1) Procedures:

Step 1: The applicant for a license submits a set of applications corresponding to each case as prescribed in items 1, 2, 3, and 4 of Article 8 of Decree 16/2024/ND-CP directly or via post or electronic environment to the Medical Department/Unit under the Ministry of Defense.

Step 2: If the applications are valid, within a period of 5 working days from the date of receiving the applications, the coordinating unit under the Ministry of Defense shall compile a list and sends it directly or via post or electronic environment to the competent Health Management Agency along with the applicant's applications and the official dispatch of request from the Head of the coordinating unit under the Ministry of Defense.

If the applications are invalid, within a period of 3 working days from the date of receiving the documents, the coordinating unit under the Ministry of Defense or the competent Health Management Agency must provide a written response to the sending unit, specifying the specific reasons for invalidity and requesting amendments or additions to the documents in the application. The time for amending or supplementing the documents in the application is not counted towards the processing time.

Step 3: Within a period of 5 working days from the date of receiving the valid documents, the competent Health Management Agency shall review the applications, complete the procedures, and submit them to the competent authority for granting a new practicing license. If a new practicing license is not granted, a written response must be provided stating the reason.

Step 4: Within a period of 20 days from the date of receiving the proposal from the competent Health Management Agency, the competent authority shall issue a decision to grant a new practicing license and return the practicing license to the applicant.

(2) Implementation methods:

- Directly.

- Postal service (military post).

- Electronic data transfer.

(3) Components, quantity of applications:

The applications include:

(3.1) Case 1: Application for a new practicing license for cases where the applicant requests a practicing license for the first time as stipulated in point a, item 1 of Article 30 of the Law on Medical Examination and Treatment 2023, and cases stipulated in point c, item 1 of Article 7 of Decree 16/2024/ND-CP, including:

- Application for a new practicing license according to Form 01 Appendix II attached to Decree 16/2024/ND-CP.

- One of the following documents: Confirmation of achieving results in the examination and evaluation of professional competence in medical examination and treatment or a practicing license issued by a competent foreign authority recognized by the Ministry of Health.

- Curriculum vitae with confirmation from the head of the agency, unit from the battalion level and above.

- Two color portrait photos, white background, size 04 cm x 06 cm, taken within a period not exceeding 06 months from the date of application.

(3.2) Case 2: Application for a new practicing license for cases where the professional title has changed and is already recorded on the practicing license as stipulated in point b, item 1 of Article 30 of the Law on Medical Examination and Treatment 2023, including:

- Application for a new practicing license according to Form 01 Appendix II attached to Decree 16/2024/ND-CP.

- One of the following documents: Confirmation of achieving results in the examination and evaluation of professional competence in medical examination and treatment or a practicing license issued by a competent foreign authority recognized by the Ministry of Health.

- Curriculum vitae with confirmation from the head of the agency, unit from the battalion level and above.

- Two color portrait photos, white background, size 04 cm x 06 cm, taken within a period not exceeding 06 months from the date of application.

- Original professional license.

(3.3) Case 3: Application for a new practicing license for cases of having the license revoked and falling under the cases specified in point c, item 1, item 2, point c, item 3, point b, item 4, item 5, item 6, point c, item 7 of Article 34 of Decree 16/2024/ND-CP:

- Application for a new practicing license according to Form 01 Appendix II attached to Decree 16/2024/ND-CP.

- One of the following documents: Confirmation of achieving results in the examination and evaluation of professional competence in medical examination and treatment or a practicing license issued by a competent foreign authority recognized by the Ministry of Health.

- Curriculum vitae with confirmation from the head of the agency, unit from the battalion level and above.

- Two color portrait photos, white background, size 04 cm x 06 cm, taken within a period not exceeding 06 months from the date of application.

- Decision to revoke the practicing license.

(3.4) Case 4: Application for a new practicing license for cases where the practitioner fails to renew the practicing license as stipulated in item 1, Article 10 of Decree 16/2024/ND-CP for more than 24 months, counting from the expiration date of the professional license:

- Application for a new practicing license according to Form 01 Appendix II attached to Decree 16/2024/ND-CP.

- One of the following documents: Confirmation of achieving results in the examination and evaluation of professional competence in medical examination and treatment or a practicing license issued by a competent foreign authority recognized by the Ministry of Health.

- Curriculum vitae with confirmation from the head of the agency, unit from the battalion level and above.

- Two color portrait photos, white background, size 04 cm x 06 cm, taken within a period not exceeding 06 months from the date of application.

- Decision to revoke the practicing license.

More details can be found in Decision 1388/QD-BQP, taking effect on April 12, 2024, annulling 24 administrative procedures related to medical examination and treatment specified in Decision 6184/QD-BQP dated December 28, 2019.
