Article 10 of the Charter issued with Circular 32/2020/TT-BGDDT stipulates the procedures for establishing a public lower secondary school council in Vietnam as follows:

- Pursuant to regulations on components of the school council in Point b Clause 1 herein, the school principal shall request the local government to assign a representative to the school council; draw up list of council members introduced by the local government, teachers and other organizations in the school; and send a proposal for decision on recognition of the school council to the chairperson of the district-level People’s Committee (for lower secondary schools and multi-level schools the highest education level of which is lower secondary level) or Director of Department of Education and Training (for upper secondary schools, multi-level schools the highest education level of which is upper secondary level, provincial-level boarding general education schools for ethnic minorities and district-level boarding general education schools for ethnic minorities with upper secondary level).

- The principal shall convene the first meeting of the school council to elect the council chairperson by secret ballot; and send a proposal for decision on recognition of the council chairperson to the chairperson of the district-level People’s Committee (for lower secondary schools and multi-level schools the highest education level of which is lower secondary level) or Director of Department of Education and Training (for upper secondary schools, multi-level schools the highest education level of which is upper secondary level, provincial-level boarding general education schools for ethnic minorities and district-level boarding general education schools for ethnic minorities with upper secondary level). The council secretary shall be appointed by the council chairperson.

In addition, on an annual basis, if there is any change to the council’s members, the school principal shall send a proposal for decision on school council strengthening to the chairperson of district-level People’s Committee (for lower secondary schools and multi-level schools the highest education level of which is lower secondary level) or Director of Department of Education and Training (for upper secondary schools, multi-level schools the highest education level of which is upper secondary level, provincial-level boarding general education schools for ethnic minorities and district-level boarding general education schools for ethnic minorities with upper secondary level).
