The development and approval of the provincial housing development program in Vietnam from August 01, 2024, shall be conducted according to the following procedures:

The development of the provincial housing development program in Vietnam, according to the Housing Law 2023, is based on the following contents:
- National housing development strategy;
- Land use planning, construction planning, urban planning;
- Local socio-economic development conditions; results of implementing the previous provincial housing development program; current housing status; housing needs during the period of developing the provincial housing development program.
According to Decree 95/2024/ND-CP, the procedure for developing and approving the provincial housing development program is implemented as follows:
- Step 1: The provincial housing management agency submits a proposal to the Provincial People's Committee for approval, including a detailed outline, estimated budget for developing the housing development program, progress and method of self-execution or hiring an experienced consulting unit to develop the program.
- Step 2: Within a maximum of 45 days from the date of receiving the proposal from the provincial housing management agency, the Provincial People's Committee is responsible for considering and approving the proposal to develop the housing development program.
- Step 3: Based on the approved content of the Provincial People's Committee, if the provincial housing management agency directly executes, it must organize the implementation of the housing development program according to the approved schedule. If hiring a consulting unit, the provincial housing management agency organizes the bidding to select the consulting unit according to the legal regulations on bidding.
During the development of the housing development program, the district-level People's Committees and relevant local agencies are responsible for cooperating with the provincial housing management agency and the consulting unit to conduct surveys, compile, and provide data; develop the housing development program.
- Step 4: After completing the draft housing development program, the provincial housing management agency must send a document to get opinions from the district-level People's Committees, relevant functional agencies, and organizations.
Within a maximum of 15 days from the date of receiving the document to get opinions from the provincial housing management agency, the consulted agencies and organizations must send a written response to the provincial housing management agency.
- Step 5: Within a maximum of 45 days from the date of sending the feedback document, the provincial housing management agency is responsible for completing and revising the draft housing development program. They must submit a proposal to the Provincial People's Committee for consideration to present it to the People's Council of the same level for approval.
The submission file to the Provincial People's Committee includes: the proposal of the provincial housing management agency, the draft housing development program, explanations, feedbacks from agencies and organizations, the draft proposal of the Provincial People's Committee to the Provincial People's Council, and the draft Resolution of the Provincial People's Council on the approval of the housing development program.
The content presented to the People's Council includes: objectives, housing development targets; capital needs for housing development; estimated land area for social housing development, housing for armed forces, relocation housing, official residence, renovation, and reconstruction of condominiums (if any), and solutions for implementing the housing development program.
- Step 6: After the Provincial People's Council approves the housing development program, within a maximum of 15 days, the Provincial People's Committee must issue a decision to approve the provincial housing development program and post this program on the Provincial People's Committee's portal, simultaneously sending it to the provincial housing management agency to post on their portal and sending the program to the Ministry of Construction to monitor the implementation.
