This is the main content specified in Circular 65/2011/TT-BCA stipulating the management of investment projects and construction bidding within the People's Public Security, issued by the Ministry of Public Security on September 30, 2011.
Assessment Procedure for Construction Bidding Results of the People's Public Security Forces (Illustration)
Article 15 of Circular 65/2011/TT-BCA provides regulations regarding the assessment of bidding results as follows:
For projects where the Minister of Public Security assigns the Director General of the General Department of Logistics and Engineering to act as the project owner, the specialized unit subordinate to the project owner (Project Management Board, or specialized advisory unit) prepares an assessment report on the bidding results based on the report from the inviting party for the project owner’s review and decision.
For projects with other project owners, the subordinate specialized department of the project owner prepares an assessment report on the bidding results based on the report from the inviting party for the project owner’s review and decision.
The assessment and approval of the contractor selection results for the bidding packages must comply with the project approval decision and the approved bidding plan.
Assessment of Bidding Results
When organizing the assessment of bidding results, the following tasks must be performed:
- Clearly state the list of bidders invited to participate, the bidders who purchased bidding documents, and the bidders who submitted bidding documents; provide reasons for bidders not participating at each stage;- The evaluation price of the inviting party or bidding consultant must clearly state two parts: the price according to the invited bidding volume, the price according to the additional volume proposed by the bidder and the bidding consultant, and the proposed winning price;- Based on the evaluation by the bidding consultant and the assessment report on the bidding results, the project owner approves the bidding results; in cases of handling bidding situations according to Clause 2, Article 70 of Decree No 85/2009/ND-CP resulting in exceeding the approved total investment, the project owner must report for supplementary approval of the total construction investment before approving the bidding results;- The approval of the package estimate (excluding contingency costs) shall only be accepted in case of supplementing the missing value to complete the approved design or price volatility; policies for any additional approval is not allowed in cases of changing the design scale, specifications, quantity, type, and material grade;- For complex packages, a multidisciplinary assessment team can be established to hire an advisory organization with legal status, sufficient capacity, and experience to conduct the assessment. The head of the specialized department (or advisory organization) is responsible for reporting the assessment results.
