On September 19, 2017, the Ministry of Industry and Trade issued Circular No. 17/2017/TT-BCT specifying the procedures and formalities for establishing border markets.
To be specific, Circular 17 stipulates that the Department of Industry and Trade of the border province takes the lead, in cooperation with relevant provincial departments and agencies including the Provincial Border Guard Command, the Military Command, the Police, External Relations, Health, Customs, Agriculture and Rural Development, Planning and Investment, Construction, Finance, Transportation, and the People's Committees of border districts/towns/cities within the province, to conduct site surveys and assess the need for establishing border market areas (points).
- Within 10 working days from the date of receiving the survey report and assessment of the need to establish border market areas (points) from the Department of Industry and Trade, the Provincial People’s Committee will send a document to the local government of the equivalent province/area of China to propose a meeting or request opinions on the co-establishment of corresponding border market areas (points) in the territories of both sides.- Based on the meeting or the written opinions of the local government at the equivalent provincial/area level of China, the border province People's Committee will send a document to the Ministry of Industry and Trade regarding the establishment of border market areas (points), clearly stating whether the border market areas (points) will be co-established in the territories of both sides or established only within the territory of Vietnam.- Within 5 working days from the date of receiving the proposal from the border province People’s Committee, the Ministry of Industry and Trade will request the opinions of relevant ministries and sectors regarding the establishment of border market areas (points). Within 10 working days from the date of receiving the written request for opinions from the Ministry of Industry and Trade, the consulted ministries and sectors will provide their written responses.- Within 10 working days after receiving the opinions of the ministries and sectors, the Ministry of Industry and Trade will provide its opinion on the establishment of border market areas (points).- Within 10 working days from the date of receiving the written opinion of the Ministry of Industry and Trade, the border province People’s Committee will issue a Decision on the establishment of border market areas (points); concurrently sending a written notice to the local government at the equivalent provincial/area level of China about the establishment of border market areas (points).- By December 31 each year, the border province People’s Committee is responsible for notifying the Ministry of Industry and Trade about the list of active and newly established border market areas (points).
