The Law on Thrift Practice and Waste Prevention 2013 was promulgated on November 26, 2013. To ensure thrift practice and prevent and curb waste, this Law stipulates that activities related to the management and use of state budget, state capital, state assets, labor, working time, and resources must be made public.
To be specific:
According to the regulations at Article 5 of the Law on Thrift Practice and Waste Combat 2013, except for fields and activities related to state secrets, the following fields and activities must be disclosed:
- Estimates, allocations, adjustments of estimates, and final accounts of the state budget of agencies and organizations using the state budget; funds sourced from the state budget;- Basic construction investment, procurement, management, and use of assets in agencies and organizations using the state budget;- Revenues to the state budget, capital mobilization for the state budget and for state credit; funds from mobilized contributions domestically and internationally; public debt in accordance with the Law on Public Debt Management;
- Planning and socio-economic development plans; sectoral and regional development plans; land use plans; urban planning, plans, and lists of investment projects, investment capital sources; construction plans; resource exploitation plans and activities;- Norms, standards, policies set by or applied by agencies and organizations; financial management and internal expenditure regulations of agencies and organizations; sectoral and field standards;- Allocation and use of labor resources;- Programs and plans for thrift practice and waste combat; results of thrift practice; acts of wastefulness and results of handling wasteful acts;- Processes and procedures for resolving work between state agencies and organizations, individuals;- Other fields as prescribed by law.
Forms of disclosure include:
- Publication of printed materials;- Notification through mass media;- Written notification to relevant agencies, organizations, and individuals;- Upload on electronic information portals;- Announce at meetings, post at the headquarters of agencies and organizations;- Provide information upon request of relevant agencies, organizations, and individuals.
In addition to the mandatory forms of disclosure as prescribed by law, heads of agencies and organizations are responsible for selecting one or several forms of disclosure for each field of activity suitable per the provisions at Clause 3, Article 5 of the Law on Thrift Practice and Waste Combat 2013.
The Government of Vietnam regulates the details of the form, content, and time of disclosure.
