The Prime Minister of Vietnam issues a Decision accompanied by the Plan for the implementation of the Law on Prevention and Combat of Human Trafficking in 2024.

Plan for the Implementation of the Law on Prevention and Combat of Human Trafficking 2024 in Vietnam

Dated February 17, 2025, the Prime Minister of the Government of Vietnam issued Decision 313/QD-TTg regarding the promulgation of the plan to implement the Law on Prevention and Combat of Human Trafficking 2024. The content of the Plan issued with Decision 313/QD-TTg 2025 is as follows:

(1) Review and systematize legal documents relating to the prevention and combating of human trafficking

- Content: Ministries, ministerial-level agencies, People's Committees of provinces, and centrally-run cities, as well as the suggestion of the Supreme People's Procuracy, the Supreme People's Court, and the Vietnam Fatherland Front. They are to organize the review of legal documents related to the 2011 Law on Prevention and Combat of Human Trafficking based on their functions, tasks, and powers within the assigned state management responsibility; take action under their authority or propose competent authorities to promptly amend, supplement, replace, annul, or introduce new regulations, ensuring compliance with the Law on Prevention and Combat of Human Trafficking 2024.

- Assignment: Ministry of Public Security, ministries, ministerial-level agencies, People's Committees of provinces, and centrally-run cities, with the suggestion of the Supreme People's Procuracy, the Supreme People's Court, the Vietnam Fatherland Front.

- Implementation timeframe:

+ Ministries, ministerial-level agencies, People's Committees of provinces, and centrally-run cities, along with suggestions to the Supreme People's Procuracy, the Supreme People's Court, and the Vietnam Fatherland Front, must send review results to the Ministry of Public Security in February 2025.

+ The Ministry of Public Security is to consolidate the review results and report to the Prime Minister of the Government of Vietnam in March 2025.

(2) Develop a Government decree detailing and guiding the implementation of the Law on Prevention and Combat of Human Trafficking 2024

- Assignment:

+ The Ministry of Labor, War Invalids and Social Affairs is responsible for drafting the decree; directly leading, and cooperating with ministries and central authorities, related agencies to draft guidance for clauses 3 of Article 22, clause 5 of Article 37, clause 7 of Article 46, clause 4 of Article 47, clause 3 of Article 56 of the Law.

+ The Ministry of Public Security is responsible for drafting guidance for clause 6 of Article 27, clause 3 of Article 28, clause 6 of Article 35 and submitting to the Ministry of Labor, War Invalids and Social Affairs before March 1, 2025 to compile and develop the draft decree.

+ The Ministry of Foreign Affairs is responsible for drafting guidance for clause 5 of Article 29, clause 3 of Article 30, clause 7 of Article 31 and submitting to the Ministry of Labor, War Invalids and Social Affairs before March 1, 2025 to compile and develop the draft decree.

+ Ministries such as the Ministry of Public Security, Ministry of National Defense, Ministry of Justice, Ministry of Health, Ministry of Education and Training, Ministry of Foreign Affairs, and Ministry of Finance; the State Bank of Vietnam, related agencies to cooperate with the Ministry of Labor, War Invalids and Social Affairs in developing the decree.

- Time for submission: March 2025.

(3) Propagate and disseminate the Law on Prevention and Combat of Human Trafficking 2024 and its detailed regulations and implementation guidance

- Content:

+ Organize training on the Law on Prevention and Combat of Human Trafficking 2024 and its detailed regulations and implementation guidance to enhance accountability and unify awareness among management officers and those directly involved in anti-human trafficking.

+ Compile legal materials on the prevention and combating of human trafficking for forces directly involved in combating human trafficking crime.

+ Upload and update the full text of the Law on Prevention and Combat of Human Trafficking 2024 and its detailed regulations, implementation guidance, and legal materials on the prevention and combating of human trafficking on the Information Portal, National Database of legal documents, and other suitable forms for easy access, exploitation, and use by officials, public employees, workers, and citizens.

+ Organize the propagation and dissemination of legal education on the prevention and combating of human trafficking through specific, diverse, and varied forms; actively apply digital transformation in the dissemination of legal education on human trafficking; cooperate with press agencies to organize thematic columns, programs, news, articles dissemination, and other forms in accordance with legal regulations on the dissemination and education of the law suited to specific audiences.

- Assignment:

+ Lead agency: Ministry of Public Security.

+ The Ministry of National Defense will lead and cooperate with the Ministry of Public Security in organizing training on the Law on Prevention and Combat of Human Trafficking 2024 and its detailed regulations, implementation guidance for the forces directly combating human trafficking crime within the People's Army.

+ The Ministry of Justice, based on its tasks under the Law on Dissemination and Education of Law, leads and cooperates with ministries, ministerial-level agencies, provincial People's Committees to propagate and disseminate legal education on human trafficking prevention.

+ The Ministry of Information and Communications will lead and cooperate with the Ministry of Public Security, the Ministry of National Defense, Ministry of Labor, War Invalids and Social Affairs, Ministry of Justice, Ministry of Education and Training, Government Coordination Council for Dissemination and Education of Law, Vietnam Women's Union, People's Committees of provinces and centrally affiliated cities to direct and guide press agencies, radio, and television at both central and local levels to disseminate, promote the Law on Prevention and Combat of Human Trafficking 2024 and its detailed regulations, implementation guidance.

+ The Ministry of Labor, War Invalids and Social Affairs will lead and cooperate with the Ministry of Public Security in organizing training on the Law on Prevention and Combat of Human Trafficking 2024 and its detailed regulations, implementation guidance for staff responsible for receiving, protecting, and supporting trafficked victims.

+ The proposal is for the Supreme People's Court and the Supreme People's Procuracy to organize training, dissemination, and thorough understanding of the Law on Prevention and Combat of Human Trafficking 2024 and its detailed regulations, implementation guidance for leaders and staff directly handling cases related to human trafficking crimes within their sectors.

The proposal for the Vietnam Fatherland Front and member organizations is to implement the propaganda plan, disseminating the Law on Prevention and Combat of Human Trafficking 2024 and its detailed regulations, and implementation guidance to members and the general population.

- Implementation timeframe: 2025 and the following years.
