Permission to select units to manage operation of common-used technical infrastructure works in Vietnam (Internet image)

Article 15 of Decree 72/2012/ND-CP stipulates that for common-used technical infrastructure works invested from budget capital source, selection of units to manage operation shall comply with provisions of current law in Vietnam. Organizations, individuals used their capital to invest in common-used technical infrastructure works shall directly manager operation or hire unit to manager operation by contract on operation management specified in Article 16 of Decree 72/2012/ND-CP. To be specific:

Operation management of the following works shall be performed by contract of operation management:

• Aerial pole;

• Cable (conductor) pole;

• Cable sewers;

• Technical trenches and tunnels.

The Contract of operation management specified in clause 1 of this Article is signed between owner and unit managing operation of common-used technical infrastructure works. The Ministry of Construction shall promulgate Form of Contract of operation management of common-used technical infrastructure works.

In addition, Article 17 of Decree 72/2012/ND-CP stipulates that common-use of the following works shall be performed by contract of common-use:

• Aerial pole;

• Cable (conductor) pole;

• Cable sewers;

• Technical trenches and tunnels;

• Roadway tunnels; railway tunnels; sewers; roadway and railway bridges.

The Contract of common-use specified in clause 1 of this Article is signed between owner or unit managing operation authorized by owner with organizations, individuals having demand of use. The Ministry of Construction of Vietnam shall promulgate Form of Contract of technical infrastructure works common-use.

More details can be found in Decree 72/2012/ND-CP, which comes into force from November 10, 2012.
