Regulations on legislative documents under the issuing authority of the Minister of Finance of Vietnam

Financial legislative documents in Vietnam include:

- Legislative documents proposed by the Minister of Finance for issuance by the competent authorities include laws, resolutions of the National Assembly; ordinances, resolutions of the Standing Committee of the National Assembly; orders, decisions of the President; decrees of the Government of Vietnam; decisions of the Prime Minister of the Government of Vietnam.

- Legislative documents under the issuing authority of the Minister of Finance include circulars; joint circulars between the Chief Justice of the Supreme People's Court, the Head of the Supreme People's Procuracy, the Auditor General, and the Minister of Finance.

In addition, the regulations on principles for drafting and issuing legislative documents are as follows:

- Ensure compliance with the principles stipulated at Article 5 of the Law on Promulgation of legislative documents and the principles stipulated in this Regulation;

- Ensure the correct spirit, content of the Vietnam Communist Party's resolutions, constitutional provisions, and policy content approved by the competent authorities; strengthen power control, prevent corruption, negative influences, group interests, and local interests in the legislative drafting process;

- Ensure the leadership of the Vietnam Communist Party during the proposal and drafting of legislative documents, the head of the drafting unit must sign to request collective opinions from the Communist Party's Party Caucus Committee of the Ministry of Finance before the Minister of Finance issues according to authority or submits to the competent authorities;

- Ensure the responsibility of the head of the unit directly supervising the building, and completing the institutional work in the unit, and taking responsibility before the Vietnam Communist Party's Party Caucus Committee and the Ministry’s leadership for the quality and progress of the presentation of projects in the assigned field of responsibility; in case of delay or failure to complete tasks, the objective and subjective causes must be clearly evaluated, and responsibility must be assumed before the Communist Party's Party Caucus Committee and the Ministry’s leadership.

Decision 2829/QD-BTC becomes effective from November 27, 2024.
