Below are the penalties applicable to violations of regulations on meteorological and hydrological observation in Vietnam from February 1, 2025, as stipulated in Decree 155/2024/ND-CP.

On December 10, 2024, the Government of Vietnam issued Decree 155/2024/ND-CP, stipulating administrative penalties in the field of meteorology and hydrology.

According to Article 9 of Decree 155/2024/ND-CP, the penalties for violating regulations on meteorological and hydrological observation in Vietnam are as follows:

- A fine ranging from 7,000,000 VND to 10,000,000 VND for any of the following violations:

+ Installing meteorological and hydrological measuring instruments in incorrect locations;

+ Monitoring at incorrect locations.

- A fine ranging from 10,000,000 VND to 15,000,000 VND for any of the following violations:

+ Incomplete meteorological and hydrological observation elements;

+ Incomplete monitoring frequency;

+ Monitoring not at the prescribed timing.

- A fine ranging from 15,000,000 VND to 25,000,000 VND for installing meteorological and hydrological observation stations that do not ensure the required density.

- A fine ranging from 25,000,000 VND to 30,000,000 VND for intentionally violating technical regulations, standards, and procedures in meteorological and hydrological observation activities.

- A fine ranging from 30,000,000 VND to 40,000,000 VND for failing to organize the implementation of meteorological and hydrological observation.

- Remedial measures:

+ Required to supplement or install monitoring stations and meteorological and hydrological measuring instruments for violations stipulated at point a, clause 1, and clause 3 of Article 9 Decree 155/2024/ND-CP;

+ Required to organize the implementation of meteorological and hydrological observation for violations specified in clause 5 of Article 9 Decree 155/2024/ND-CP.

Note: The monetary fines specified in Chapter II of Decree 155/2024/ND-CP apply to administrative violations committed by individuals. For organizations committing the same violations, the fines shall be twice that imposed on individuals. (According to clause 1, Article 5 of Decree 155/2024/ND-CP)

Main penalty forms and administrative penalties in the field of meteorology and hydrology in Vietnam from February 1, 2025

The main penalty forms and administrative penalties in the field of meteorology and hydrology are specified in detail at clause 1, Article 4 of Decree 155/2024/ND-CP as follows: For each administrative violation in the field of meteorology and hydrology, the violating organization or individual shall be subject to the main penalty form, which is a monetary fine. The maximum fine for a single administrative violation in the field of meteorology and hydrology is 50,000,000 VND for individuals and 100,000,000 VND for organizations.

Refer to the details in the Decree 155/2024/ND-CP effective from February 1, 2025.

Decree 155/2024/ND-CP repeals content in the following Decrees:

- Clause 2, Article 1, Chapter II, point a, clause 2, Article 21; the phrase "meteorology and hydrology" in the Decree title, decree basis, Chapter IV title, in clause 1 and clause 4, Article 1, in Article 2, clause 1, Article 3, point a, clause 1, Article 20 of Decree 173/2013/ND-CP of the Government of Vietnam stipulating administrative penalties in the field of meteorology, hydrology, surveying, and mapping;

- Decree 84/2017/ND-CP of the Government of Vietnam amending and supplementing several articles of Decree 173/2013/ND-CP of the Government of Vietnam stipulating administrative penalties in the field of meteorology, hydrology, surveying, and mapping;

- Article 3 of Decree 04/2022/ND-CP of the Government of Vietnam amending and supplementing several articles of the decrees on administrative penalties in the fields of land; water resources and minerals; meteorology, hydrology; surveying, and mapping.
