Order Police Officers Are Prohibited from Making Promises to Resolve Administrative Procedures

This is a regulation mentioned in Circular 15/2020/TT-BCA issued by the Minister of Public Security regarding the implementation of democracy in the administrative management of social order.

Officers and soldiers of the Administrative Management Police regarding social order are not allowed to promise, agree or receive money, property, other material benefits, or non-material benefits to resolve administrative procedures regarding social order. In addition, the actions that officers and soldiers of the Administrative Management Police regarding social order are prohibited from doing are specified in Circular 15/2020/TT-BCA as follows:

- Do not cause inconvenience or harass the people; do not request agencies, organizations, or individuals to provide documents or procedures outside the regulations.

- Do not abuse the assigned duties and powers to infringe on the interests of the State, the lawful rights and interests of agencies, organizations, enterprises, and individuals.

- Do not accept letters, petitions, and resolve work for individuals or organizations at private homes or any place other than the office headquarters.

In addition, in the administrative management of social order, the unit head must adhere to the following responsibilities and powers:

- Organize, command, guide, urge, and inspect officers and soldiers within the unit to perform and be responsible for the outcomes of the implementation of the contents stipulated in Section 1, Chapter II of this Circular.

- Equip necessary facilities, equipment, and means for officers and soldiers to perform tasks in the administrative management of social order. Arrange sufficient and qualified officers to carry out citizen reception tasks; organize the rotation of officers as prescribed.

- Organize the reception, settlement of complaints, and denunciations from agencies, organizations, and individuals as prescribed.

- Decide within their competence or propose competent authorities to decide on the contents specified in Article 8 of this Circular.

- Consider, approve, or propose competent authorities to resolve the implementation of administrative management contents on social order as proposed by the agency, organization, individual, and as per the suggestions of the officers and soldiers handling citizen reception.

- Promptly handle acts that abuse the implementation of democracy in the administrative management of social order to infringe upon the interests of the State, and the lawful rights and interests of agencies, organizations, and individuals according to legal regulations.

This Circular stipulates that every 6 months and annually, the Police Departments of the provinces and centrally-run cities shall organize reviews and summaries of the implementation of this Circular and report the results in writing to the Ministry of Public Security (through the Department of Administrative Management Police regarding social order).
