Operating a Car or Motorbike That Is Too Dirty May Be Fined Up to 1 Million Dong?

Decree 100/2019/ND-CP stipulates the administrative penalties in the field of road and railway traffic, effective from January 01, 2020, and replaces Decree 46/2016/ND-CP.

This Decree stipulates that anyone operating a car with a license plate that is obscured (possibly due to dirt making it unclear, or deliberately covered by the vehicle owner) shall be fined from 800,000 VND to 1,000,000 VND (this fine is also stipulated in Decree 46/2016/ND-CP prior). To be specific::

Article 16. Penalties for operating cars (including trailers or semi-trailers towed) and similar vehicles in violation of vehicle conditions when participating in traffic

3. A fine of 800,000 VND to 1,000,000 VND shall be imposed for any of the following violations:

c) Operating a vehicle without sufficient license plates or license plates in the wrong position; unclear license plates; bent, obscured, or damaged license plates; painted or pasted to change the letters, numbers, or color of the license plate;

For motorcycles, the fine for operating a vehicle with an obscured license plate (possibly due to dirt making it unclear, or deliberately covered by the vehicle owner) shall be from 100,000 VND to 200,000 VND (previously under Decree 46, the fine was from 80,000 VND to 100,000 VND). To be specific::

Article 17. Penalties for operating motorbikes, electric bikes, similar vehicles violating vehicle conditions when participating in traffic

1. A fine of 100,000 VND to 200,000 VND shall be imposed for any of the following violations:

a) Operating a vehicle without a horn; license plate lighting; brake lights; left rear-view mirror or having but no function;

b) Operating a vehicle with a non-conformable license plate; unclear license plate; bent, obscured, or damaged license plate; painted or pasted to change the letters, numbers, or color of the license plate;

For tractors (including trailers towed) and specialized motorcycles, the fine for this act of obscuring the license plate shall be from 300,000 VND to 400,000 VND (previously, Decree 46 did not stipulate a fine for this act of drivers of tractors and specialized motorcycles). To be specific::

Article 19. Penalties for operating tractors (including trailers towed), specialized motorcycles violating vehicle conditions when participating in traffic

1. A fine of 300,000 VND to 400,000 VND shall be imposed for any of the following violations:

a) Operating a vehicle with a license plate in the wrong position; unclear license plate; bent, obscured, or damaged license plate; painted or pasted to change the letters, numbers, or color of the license plate;

Thus, if traffic participants intentionally cover car or motorcycle license plates (e.g., using a mask to cover it, or the license plate is too dirty making the letters, numbers unclear; bent, obscured, or damaged license plate), they can be fined with the above administrative fines.
