The Minister of Planning and Investment of Vietnam promulgates Circular 02/2023/TT-BKHDT dated April 19, 2023, amending Circular 01/2021/TT-BKHDT guiding enterprise registration.

Circular 02/2023/TT-BKHDT has added many regulations related to business households, including the application of online business household registration documents from July 1, 2023.

Specifically, the application file for business household registration via the electronic information network (online) according to Article 5g of Circular 01/2021/TT-BKHDT (amended in Circular 02/2023/TT-BKHDT) is as follows:

- An application file for business and household registration via the electronic information network (online) includes the documents specified in Decree 01/2021/ND-CP and is presented in electronic document form.

Specifically, a business household registration dossier includes:

+ Application for business household registration;

+ Legal papers of the individual, for the head of the household business, the household member registering the business household in case the household members register the business household;

+ A copy of the minutes of the meeting of household members on the establishment of the business household in case members of the household register as a business household;

+ A copy of the household member's authorization letter for one member to be the owner of the household business, in case the household members register as a household business.

In particular, the application for business household registration via the electronic information network has the same legal value as the paper application for business household registration.

- An application for business or household registration via the electronic information network is approved when it fully meets the following requirements:

+ There are full papers, and the contents of those papers are fully declared in accordance with regulations such as paper business household registration documents and presented in electronic document form.

The name of the electronic document must correspond to the name of the type of paper in the paper business household registration file.

Business owners, household members, or other individuals who sign the business household registration dossier can use digital signatures to sign directly on electronic documents or sign directly on paper documents and scan the paper documents in different formats. according to the law;

An electronic document is a document in the form of a data message created from or digitized from a paper document that accurately and completely represents the content of the paper document. Electronic documents can be in ".doc" or ".docx" or ".pdf’ format.

+ The business household registration information declared on the business household registration information system must be entered completely and accurately according to the information in the paper business household registration dossier; including information about the applicant's phone number and email address;

+ The application for business household registration via the electronic information network must be authenticated by the digital signature of the business household head or the person authorized by the business household owner to carry out the business household registration procedures.

In case of authorization to carry out business household registration procedures, the application for business household registration via the electronic information network must be enclosed with the papers and documents specified in Clause 4, Article 84 of Decree 01/2021/ND-CP.

- In cases of amending and supplementing the application for business household registration via the electronic information network, the time limit for the business household to perform this work is 60 days from the date the district-level business registration agency issues a notice requesting amendment and supplementation of the dossier.

After the above period, if the business household's revised and supplemented application is not received, the district-level business registration agency will cancel the business household registration application according to the process on the business household registration information system.

What is business household registration via the electronic information network (online)?

Business household registration via electronic information network (online) means that the founder of a business household carries out the procedures for business household registration according to the provisions of Decree 01/2021/ND-CP on the business household registration information system under the National Business Registration Information System through the National Business Registration Portal.

The applicant for business household registration shall declare information, download an electronic document, and use a digital signature to authenticate the business household registration application according to the process on the business household registration information system.

The business registration authority of the district shall return the receipt of the application and the results of the settlement of business household registration procedures to the applicant via the electronic information network according to the process on the information system for business household registration.
