The content of the article presents the official regulations on the exam and issuance of practicing certificates for real estate brokers in Vietnam from August 1, 2024, including the procedures for issuance of this certificate.

On July 24, 2024, the Government of Vietnam issued Decree 96/2024/ND-CP detailing certain provisions of the Law on Real Estate Business 2023.
* Exam candidates
Exam candidates include: Vietnamese citizens, overseas Vietnamese according to the law on nationality, and foreigners who meet the conditions to take the exam.
* Exam conditions
Candidates must meet the following conditions:
- Have full civil capacity, not subject to criminal prosecution or serving a prison sentence.- Graduated from high school or higher.- Have a certificate of completion of a training course on the knowledge of real estate brokerage practice.- Submitted examination registration documents and examination fees to the provincial-level People's Committee.
* Exam registration documents
- One application form with a 4x6cm photo taken within 6 months up to the registration date (according to the form in Appendix XXI Decree 96/2024/ND-CP).
- One certified copy of the Citizen Identification Card, Identification Card or Passport as prescribed by law; documents proving Vietnamese nationality or a certificate of being of Vietnamese origin according to nationality laws or passport (or original for comparison).
- One certified copy of the certificate of completion of the real estate brokerage practice knowledge training course.- A certified copy of the high school diploma (or equivalent) or higher.
- Two 4x6cm photos taken within 6 months up to the registration date, two stamped envelopes with the recipient’s full name, phone number, and address.
- A certified copy and a certified translation of the certificate issued by a foreign entity (for foreigners and Vietnamese who hold a foreign-issued practicing certificates for real estate brokers that is still valid).

* Exam format, duration, and language
- Exam format and duration:
+ Basic knowledge section: written exam, multiple-choice exam, or a combination of both, duration of 120 minutes.
+ Specialized knowledge section: written exam, multiple-choice exam, or a combination of both, duration of 120 minutes.
- Exam language: Vietnamese is to be used (in case of foreign candidates, translation is allowed).
* Exam content
- Basic knowledge section includes: Laws related to real estate business; laws related to land; investment laws; civil laws related to real estate business; notary laws related to real estate business; enterprise laws related to real estate business; tax and fee laws in real estate transactions; laws on anti-money laundering in real estate business; laws on handling administrative violations related to real estate business; an overview of the real estate market; real estate evaluation and consultancy;
- Specialized knowledge section includes: Overview of real estate brokerage services; real estate brokerage procedures and skills; practical situation resolution.
Candidates must pass all the above sections to be granted a certificate, except candidates with a foreign-issued real estate brokerage certificate that is still valid only need to take the basic knowledge section, not the specialized knowledge section.
* Conditions for recognizing a passing exam
To pass the exam, the candidate's results must be as follows:
- Basic knowledge section score of 70 or higher (scale of 100).- Specialized knowledge section score of 70 or higher (scale of 100).
* Approval and announcement of practicing certificates for real estate brokers exam results
Article 29 Decree 96/2024/ND-CP stipulates the approval and announcement of the results of the practicing certificates for real estate brokers exam as follows:
- The Chairman of the exam council approves the exam results based on the grading results of each exam section.
- Exam results are announced at the provincial People's Committee and on the provincial People's Committee’s information portal.
- Within 10 days from the announcement of the exam results, if candidates request regrading, they must submit a petition to the provincial People's Committee or follow the announcement of the provincial People's Committee. The exam council organizes regrading and reports to the Chairman of the provincial People's Committee to approve the supplementary list of qualified candidates.
- Within 20 days from the announcement of the exam results, the provincial People's Committee organizes a re-exam for candidates who did not meet the requirements. Candidates who did not meet the requirements for any section must retake that section. Each exam period only organizes one re-exam, and candidates do not have to pay re-exam fees.
