No Adjustment of Salaries for Subjects Exceeding Staffing Targets

officials and public employees, individuals working under the statutory pay rate adjustment as guided by Circular 06/2018/TT-BNV, in which, attention should be paid to the following content:

The total number of officials and public employees, individuals working to determine the cost needs for adjusting the statutory pay rate, is the actual number present at the time of July 1, 2018. The total staffing is based on the following grounds:

- For the staffing of ministries and central agencies: staffing of the agencies of the National Assembly, the Supreme People’s Court, the Supreme People’s Procuracy, the State Audit Office according to the Resolution of the Standing Committee of the National Assembly; staffing of the Office of the President according to the Decision of the President; staffing of the central agencies of the Communist Party, political-social organizations according to the announcement of the Central Organization Committee; staffing of the Ministry of National Defense, Ministry of Public Security according to the decision of the competent authority, …- For the staffing of provinces and centrally-run cities: state administrative staffing according to the assignment decision of the Ministry of Home Affairs; staffing of local Communist Party agencies, political-social organizations according to the announcement of the Central Organization Committee. Particularly, staffing of specialized officials, commune-level officials is determined within the staffing framework as stipulated in Clause 1 Article 4 Decree 92/2009/ND-CP.

Individuals working under labor contract policies within the people's army and people's public security forces are classified for salaries according to Decree 204/2004/ND-CP.

The demand for salary adjustment implementation of ministries, central and local agencies sent to the Ministry of Finance does not include:

- The number of subjects exceeding the staffing targets assigned (or approved) by the competent authority in 2018; the agencies and units handle according to the provisions of the law.- Individuals working under contract policies as stipulated in Clause 4 Article 2 Decree 72/2018/ND-CP; the agencies and units arrange from the state budget estimates assigned and other legitimate revenue sources to pay these subjects.

Circular 68/2018/TT-BTC takes effect from September 19, 2018.
