On July 31, 2024, the Minister of Construction issued Circular 05/2024/TT-BXD detailing certain provisions of the Housing Law 2023.

Newest regulations on fostering knowledge of law related to managing, operating, and using apartment buildings in Vietnam

According to Article 13 of Circular 05/2024/TT-BXD, regulations on fostering knowledge of law related to managing, operating, and using apartment buildings in Vietnam are specified as follows:

Knowledge of law related to managing, operating, and using apartment buildings includes the following two lectures:

(1) Lecture on general legal knowledge including: housing law, construction law, fire prevention and fighting law, civil law, land law, real estate business law related to apartments;

(2) Lecture on specific content in managing, operating, and using apartments.

Syllabus of the lecture on knowledge of law related to managing, operating, and using apartment buildings in Vietnam

- For the general legal knowledge lecture on managing, operating, and using apartments specified in Clause 1, Article 13 of Circular 05/2024/TT-BXD, the following content is included:

+ General legal provisions regarding housing law, construction law, fire prevention and fighting law, civil law, land law, real estate business law related to apartments;

+ Provisions related to investment activities, renovation, and maintenance of apartments;

+ Provisions related to land use rights and apartment ownership rights;

+ Provisions related to housing transactions, service contracts for managing and operating apartments, and apartment maintenance contracts.

- For the lecture specified in Clause 2, Article 13 of Circular 05/2024/TT-BXD, the following content is included:

+ Provisions of housing law on managing and using apartments;

+ Contents of the regulations on managing and using apartments.

- In addition to the content specified in Clause 1, Clause 2, Article 14 of Circular 05/2024/TT-BXD, training institutions may add other related content based on the needs of the trainees.

Regulations on training of professional knowledge and skills related to managing, operating, and using apartment buildings in Vietnam

- The mandatory theoretical part includes the following 07 modules:

+ Module 1: Operational management of apartments;

+ Module 2: Management and operation of electrical, water supply and drainage, and ventilation-heating systems in apartments;

+ Module 3: Management and operation of fire prevention and fighting systems and equipment in apartments;

+ Module 4: Management and operation of elevators and escalators in apartments;

+ Module 5: Environmental sanitation management, apartment landscape and wastewater treatment management;

+ Module 6: Risk management, security management, administrative management, and disaster response in apartments; requirements for civilized living in urban areas and apartments (if any);

+ Module 7: Application of information technology in managing and operating apartments.

- In addition to the 07 modules specified in Clause 1, Article 15 of Circular 05/2024/TT-BXD, training institutions may add other training modules based on the needs of the trainees.

- The mandatory practical part includes the following content:

+ Field survey on the management and operation activities of apartments;

+ Practical exercises in security, customer care, environmental sanitation, fire safety, rescue operations, and use of digital technology and apartment management software;

+ Other practical exercises related to the management and operation of apartments based on the needs of the trainees;

+ After the survey and practical exercises, the trainees must write a summary report including the following content: coordination regulations between relevant organizations and individuals in managing and operating the apartments; evaluation of security, fire safety, environmental sanitation, and the application of information technology in managing and operating the apartments.

More details can be found in Circular 05/2024/TT-BXD which comes into force in Vietnam from August 1, 2024.
