On May 17, 2018, the Government of Vietnam issued Decree 80/2018/ND-CP amending certain provisions on voluntary drug rehabilitation stipulated in Decree 147/2003/ND-CP and Decree 135/2004/ND-CP.
The voluntary drug addiction treatment service contract is stipulated as follows:
- The transaction between the individual in need of drug addiction treatment and the drug addiction treatment service provider is a civil relation, executed through a voluntary drug addiction treatment service contract. For individuals under 18 years old in need of drug addiction treatment, the contract must be executed through a parent or guardian.- When entering into the contract, the contracting individual must verify their identity using one of the following documents: Citizen Identity Card; Identity Card; Passport; Birth Certificate; Driver's License.- Immediately upon the individual's proposal for drug addiction treatment services and identity verification, the drug addiction treatment facility is responsible for clearly explaining the rights and obligations of the addict and the rights and obligations of the service provider.- The voluntary drug addiction treatment service contract is signed between the head of the drug addiction treatment facility and the individual in need of addiction treatment, or the parent or guardian for individuals under 18 years old.- Upon receiving a voluntary individual for drug addiction treatment, the treatment facility must check and record in writing the reception of the individual, personal belongings, and possessions (if any); conduct an initial health examination.
