New Regulations on Making Administrative Violation Records by Transportation Inspectors

On November 07, 2016, the Ministry of Transport issued Circular 32/2016/TT-BGTVT amending and supplementing Circular 02/2014/TT-BGTVT regulating the specialized inspection process, administrative violation sanctioning; work planning tasks, report policies, and internal management of the Transport Inspection sector.

According to the new regulations, the preparation of administrative violation records by traffic inspectors is carried out as follows:

- Upon receiving information about the violation, the assigned officer or the individual responsible for handling the case shall prepare the record;- During an inspection by a team, the Team Leader directs the team members, including inspectors, official inspectors, or other authorized persons to prepare the administrative violation record according to the provisions of the law. If necessary, the Team Leader may directly prepare the record.- Inspectors or civil servants prepare the administrative violation record when conducting independent inspections. In cases where an assistant writes the record, the inspector or official inspector must sign and clearly state their full name on the record and take responsibility for its content:
