New: Amending regulations on signatories to the acceptance record of construction works in Vietnam

Recently, Circular No. 04/2019/TT-BXD has been issued by the Ministry of Construction of Vietnam, providing amendments to Circular No. 26/2016/TT-BXD on elaboration of a number of aspects of construction work quality control and maintenance.

Point a Clause 2 Article 1 of Circular No. 04/2019/TT-BXD of the Ministry of Construction of Vietnam provides amendments to Clause 2 Article 9 of Circular No. 26/2016/TT-BXD on signatories to the acceptance record of construction works and construction items prior to operation. Specifically, according to new regulations, signatories to the acceptance record are:

- The investor’s legal representative or authorized person;

- Legal representatives of the construction contractor and chief supervisor;

- Legal representative and chief supervisor of the prime contractor or EPC contractor if the EPC contract is concluded; legal representative and chief supervisor of each consortium’s member in case of contractor consortium;

- The legal representative of the construction prime contractor or EPC contractor and the design contractor’s representative upon request of the investor;

- The legal representative of the competent authority signing the project contract or the authorized person in case of PPP projects.

Besides, Circular No. 04/2019/TT-BXD also stipulates that if multiple prime contractors engage in constructing a work item or construction work, the investor may carry out commissioning and make a record of commissioning of the work item or construction work with respect to each prime contractor.
