Maximum Penalty for Non-Compliant Private Tutoring by Teachers?

In addition to their main teaching duties at schools, many teachers also organize additional tutoring outside of school to increase their income and ensure a better standard of living. However, if the organization of additional tutoring does not comply with regulations, it may be subject to administrative penalties.

Currently, the provisions of Article 4 of Circular 17/2012/TT-BGDDT clearly stipulate 04 cases in which teachers are not allowed to tutor, including:

- When the school organizes classes for students twice a day;

- Not teaching elementary students except for arts, physical education, sports, and life skills training;

- Universities, colleges, vocational schools, and professional educational institutions shall not tutor content from the general education program;

- Teachers who receive salaries from the public service provider's salary fund are not allowed to organize tutoring but may participate in tutoring outside the school; not tutoring students they are currently teaching at school without the principal's consent.

Additionally, the Education Law 2005 stipulates that forcing students to take extra classes is one of the behaviors that teachers are prohibited from engaging in.

Regarding penalties for tutoring behavior, they are stipulated in Decree 138/2013/ND-CP as follows:

- Organizing tutoring without ensuring proper facilities: Fine from 1,000,000 - 2,000,000 VND;

- Organizing tutoring for inappropriate subjects: Fine from 2,000,000 - 4,000,000 VND;

- Organizing tutoring with content not permitted: Fine from 4,000,000 - 6,000,000 VND;

- Organizing tutoring without a license: Fine from 6,000,000 - 12,000,000 VND.

In addition to the monetary fines mentioned above, violators may also be subject to additional measures such as revocation of their tutoring license, suspension of tutoring activities, etc.

Thus, in the case where teachers wish to tutor, they must comply with the regulations on tutoring as specified in Circular 17/2012/TT-BGDDT and avoid violations related to tutoring practices under Decree 138/2013/ND-CP.
