Management of Death Sentenced Inmates in Temporary Detention

Circular 27/2018/TT-BQP on Regulations for Detention Facilities in the People's Army was issued on March 12, 2018. One of the fundamental contents of this document is the regulation on the management of individuals sentenced to death who are being temporarily detained.

According to the regulations in the Internal Regulations of Custody Facilities in the People's Army issued with Circular 27/2018/TT-BQP, the management of individuals sentenced to death in custody is as follows:

* Visitation Regulation

- For individuals sentenced to death whose verdicts have not yet taken legal effect, visitation policies are implemented as per the rules applicable to detainees stipulated in Article 22 of the Law on Temporary Detention and Custody and in Articles 9, 12, 13, 14, 15, and 16 of the Internal Regulations of Custody Facilities in the People's Army issued with Circular 27/2018/TT-BQP.

- For individuals sentenced to death whose verdicts have taken legal effect and are awaiting execution, visitation is conducted according to Articles 10 and 12 of these Internal Regulations and is decided by the Superintendent of the detention center; visits are only allowed when safety conditions are ensured. The duration should not exceed one hour per visit.

- The visitation process must be supervised by two officers and supported by guards.

* Management of Individuals Sentenced to Death

- Individuals sentenced to death must be detained separately in the Cells for those with death sentences, with a sign “Cell for individuals with death sentence” posted outside the cell door.

- The cell for individuals sentenced to death must have a secure, safe door system equipped with locks, shackles for one leg, and a recording system.

- When taking individuals sentenced to death out of the cell to meet relatives, work with authorities, organizations, or competent individuals, leg shackles and handcuffs must be used. One side of the handcuffs should only be unlocked when in the isolation area, and one side of the handcuff must be hooked to a fixed position, with leg shackles remaining locked throughout the meeting or work session.

Circular 27/2018/TT-BQP on Internal Regulations of Custody Facilities in the People's Army took effect on April 30, 2018.
