Ms. Nguyen Thi Duyen (Email: Thuyduyen***@gmail.com) has a question addressed to the Law Secretary with the content: “I would like to ask whether low salary support money and year-end income increase money are related to each other? Is it true that if I receive the low salary support money, I will not receive the year-end personal income increase money anymore?”.
In your case, Thu Ky Luat provides the following clarification:
Low salary support and year-end personal income increase are two separate amounts. To be specific:
- According to Point c, Clause 1, Article 21 of Decree 05/2015/ND-CP, “low salary support” is considered one of the “other additional amounts” apart from salary, salary allowances and related to the performance of work or job titles in the labor contract;- According to Clause 1, Article 103 of the Labor Code 2012, “year-end income increase” is considered a bonus based on annual production and business results and the level of completion of the worker's duties.
Since low salary support and year-end income increase are two entirely different amounts, although you have received low salary support, you are still entitled to receive the year-end personal income increase, with the bonus level based on the Labor Contract or the Company's Reward Regulations.
