On September 30, 2024, the Minister of Public Security of Vietnam issued Circular 46/2024/TT-BCA amending and supplementing several articles of Circular 67/2019/TT-BCA regulating the implementation of democracy in ensuring traffic order and safety in Vietnam.
The information to be disclosed by the People's Public Security force in ensuring traffic order and safety in Vietnam from November 15, 2024 is stipulated in Article 5 of Circular 67/2019/TT-BCA (amended by Circular 46/2024/TT-BCA) as follows:
(1) In patrol, control, and handling of administrative violations:
- Procedures for patrol, control, and handling of administrative violations;
- Name, address, telephone number of the duty desk, suggestion mailbox, social media account, citizen reception hours for handling administrative violations of the police agency responsible for patrol, control, and handling of administrative violations;
- Technical professional means, equipment used to detect administrative violations as regulated by the Administrative Violation Handling Law 2012;
- Duties and powers of officers and soldiers when performing patrol and handling administrative violations;
- Rights and obligations of citizens when officers and soldiers carry out inspections, controls, and handling of administrative violations.
(2) Vehicle registration and number plate issuance:
- Procedures for registration and issuance of number plates;
- Name, address, working hours, duty desk telephone number, suggestion mailbox, social media account of the police agency responsible for vehicle registration and number plate issuance;
- Number plates for auction, vehicle registration fees;
- Violations and penalty forms for breaches of regulations on vehicle registration and number plate issuance;
- Responsibilities of the police agency and officers, soldiers performing vehicle registration duties;
- Rights and obligations of citizens when executing rules on vehicle registration and number plate issuance.
(3) Traffic command and control:
- Procedures for traffic command and control;
- Duties and powers of officers and soldiers when performing traffic command and control;
- Routes restricted or prohibited to certain vehicle types when required for public security, order, and social safety.
(4) Investigation and resolution of traffic accidents:
- Procedures for investigating and resolving traffic accidents;
- Duties and powers of officers and soldiers when investigating and resolving traffic accidents;
- Responsibilities of individuals, agencies, and organizations upon the occurrence of traffic accidents.
- Name, address, duty desk telephone number, suggestion mailbox, social media account of the police agency responsible for investigating and resolving traffic accidents.
According to Article 6 of Circular 67/2019/TT-BCA (amended by Circular 46/2024/TT-BCA), depending on the characteristics, nature, and content needing public disclosure, the police agency shall apply one, several, or all of the following forms of public disclosure:
- Posting on the Electronic Portal; Website, social media account of the police agency.
- Publication in the Gazette.
- Posting at the headquarters of the police agency.
- Public disclosure through mass media.
- Through citizen reception; press conferences; press releases; activities of spokespersons in the People's Public Security forces as prescribed by law.
