Implementing the Execution of Criminal Sentences in the Community Must Ensure the Following Principles

This is the main content stipulated in Circular 65/2019/TT-BCA regarding the execution of criminal sentences in the community issued by the Ministry of Public Security on November 28, 2019.

According to Article 3 of Circular 65/2019/TT-BCA, the implementation of criminal enforcement in the community must ensure the following principles:

  1. Compliance with the Constitution and the law.

  2. Ensuring strict enforcement of judgments and decisions that have legal effect by the Court.

  3. Ensuring proper authority, order, and procedures as regulated by the Law on Criminal Enforcement and other related laws.

  4. Managing, supervising, and educating the person serving the sentence strictly and effectively; creating the most favorable conditions for the person serving the sentence to perform their sentence, complete their punishment early, and become a useful person for society; preventing and stopping any law violations and criminal acts by the person serving the sentence; enabling organizations and individuals to participate in managing, supervising, and educating the person serving the sentence.

  5. The implementation of criminal enforcement in the community must be carried out uniformly, with close coordination between police units and local authorities; ensuring administrative and judicial reform requirements; effectively serving the work of ensuring security, public order, and socio-economic development.

The criminal enforcement in the community includes the execution of suspended sentences, warnings, non-custodial reform, residential prohibition, probation, deprivation of certain civil rights, prohibition from holding certain positions, prohibition from practicing certain professions or performing certain jobs; execution of decisions to postpone the serving of imprisonment sentences, temporary suspension of imprisonment sentences; execution of decisions for early conditional release.
