The Cybersecurity Law was officially passed during the 5th session of the XIV National Assembly and will take effect from January 01, 2019. When using Facebook or other social networking sites, users need to adhere to certain principles.
As per the draft Cybersecurity Law presented to the National Assembly for approval, specifically in Article 42, it is stipulated that when using cyberspace, organizations and individuals are responsible for:
Article 42. Responsibilities of agencies, organizations, individuals using cyberspace 1. Comply with the provisions of the law on cybersecurity protection; 2. Timely provide information related to cybersecurity protection, cybersecurity threats, and cybersecurity violations to competent state management agencies and cybersecurity protection forces; 3. Implement the requirements and guidelines of competent state management agencies in cybersecurity protection; assist and facilitate agencies, organizations, and responsible persons in carrying out measures to protect cybersecurity. |
Additionally, to avoid violating the Cybersecurity Law, Facebook users need to be aware not to post images and contents that:
- Distort history, deny revolutionary achievements, sabotage the great national unity bloc, insult religion, discriminate on gender, or racism;- Provide false information that causes public confusion, damages economic-social activities, hinders the activities of state agencies or public officers, or infringes the legitimate rights and interests of organizations or individuals;- Spread obscene, depraved, criminal content; undermine the nation's fine customs, social ethics, and public health.
These are prohibited acts when using cyberspace as regulated in Article 8 of the Cybersecurity Law.
Therefore, from January 1, 2019, users of Facebook, Zalo, etc., should be cautious in sharing and posting information. Depending on the nature and severity of the violation, the offender will be subject to disciplinary action, administrative fines, or criminal prosecution; if damage is caused, compensation must be made according to the law.
