Hanoi-Vietnam: Regulations to extra-teaching pay for lecturers and teachers at all educational levels

1. Conditions for receiving extra-teaching pay

According to the provisions of Article 2 of Joint Circular href="https://lawnet.vn/vb/thong-tu-07-2013-bgddt-bnv-btc-tra-luong-day-them-gio-doi-voi-nha-giao-2afc3.html">07/2013/TTLT-BGDDT-BNV-BTC, teachers who teach overtime will receive extra-teaching pay if their salary is ranked according to Decree 204/2004/ND-CP, complete teaching tasks, and other work tasks per the policies applicable to educators.

This Circular also stipulates that extra-teaching pay will only be paid to units or subjects lacking the number of educators as approved by competent authorities. Units or subjects with no shortage of educators will only receive extra-teaching pay when educators are on sick leave, maternity leave as prescribed by the Law on Social Insurance, or attending training, participating in inspection, auditing, and other tasks assigned and mobilized by competent authorities, requiring other educators to substitute.

Note: The extra-teaching hours counted for overtime pay should not exceed the overtime limit as prescribed by law.

2. Method of calculating extra-teaching pay for educators

The monthly salary used as a basis for calculating educators' extra-teaching pay includes the current salary under grade/step, salary allowances, and the difference coefficient (if any).

Extra-teaching pay for lecturers and teachers at all educational levels is calculated as follows:

- Extra-teaching pay/academic year = extra-teaching hours/academic year x Pay for 1 extra-teaching hour;

- Pay for 1 extra-teaching hour = Pay for 1 teaching hour x 150%;

- Pay for 1 teaching hour:

+ For teachers in preschool institutions, general education institutions, intermediate vocational schools, and teachers, lecturers of vocational education institutions:

For educators involved in administrative tasks or assigned as head of the Young Pioneers Unit, Youth Union officials, or organizations in preschool institutions, general education institutions, intermediate professional schools, and vocational education institutions, it is calculated using the above formula, wherein the teaching hours/year is the teaching hours/year of teachers in the same grade and subject of that educational institution.

+ For lecturers in universities, training and retraining institutions of ministries, ministerial-level agencies, and provincial political schools:

For educators involved in administrative tasks, Youth Union officials, or organizations participating in teaching at universities, training and retraining institutions of the Ministry, ministries, ministerial-level agencies, and provincial political schools, it is calculated using the above formula, wherein the teaching hours/year is the teaching hours/year of lecturers in the same title, subject of that educational institution.

- Extra-teaching hours/academic year = [Actual teaching hours/academic year + Converted teaching hours/academic year (if any) + Extra teaching hours/academic year (if any) + Reduced teaching hours according to policies/academic year (if any)] - (Teaching hours/year).

Where:

+ Converted teaching hours/academic year are implemented according to Clause 3, Article 5 of Circular href="https://lawnet.vn/vb/thong-tu-48-2011-tt-bgddt-che-do-lam-viec-giao-vien-mam-non-1ff75.html">48/2011/TT-BGDDT; Article 11 of Circular href="https://lawnet.vn/vb/thong-tu-28-2009-tt-bgddt-quy-dinh-che-do-lam-viec-giao-vien-pho-thong-178e7.html">28/2009/TT-BGDDT; Clause 4, Section II and Clause 4, Section III of Circular href="https://lawnet.vn/vb/thong-tu-09-2008-tt-bldtbxh-che-do-lam-viec-giao-vien-day-nghe-107d5.html">09/2008/TT-BLĐTBXH; Article 12 of Decision href="https://lawnet.vn/vb/quyet-dinh-18-2007-qd-bgddt-quy-dinh-che-do-cong-tac-giao-vien-giang-day-trung-cap-chuyen-nghiep-d52e.html">18/2007/QD-BGDDT; Clause 2, Article 11 and Point d, Clause 3, Article 13 of Decision 64/2008/QD-BGDDDT; Clause 3, Clause 4, Article 10, and Clause 2, Clause 3, Article 11 of Joint Circular 06/2011/TTLT-BNV-BGDDT;

+ Extra teaching hours/academic year are applied to teachers teaching classes with disabled children learning integration as prescribed in Clause 3, Article 4 of Circular 48/2011/TT-BGDDT;

+ Reduced teaching hours according to policies/academic year are implemented according to the provisions of Clause 1, Clause 2, Article 5 of Circular 48/2011/TT-BGDDT; Articles 8, 9, 10 of Circular 28/2009/TT-BGDDT; Articles 9, 10, 11 of Decision 18/2007/QD-BGDDT; Clause 6, Section II and Clause 4, Section III of Circular 09/2008/TT-BLĐTBXH; Clause 3, Clause 4, Article 12 of Joint Circular 06/2011/TTLT-BNV-BGDDT.

3. Method of determining the teaching hours/year for educators

According to the provisions in Point dd, Clause 1, Article 4 of Joint Circular 07/2013/TTLT-BGDDT-BNV-BTC, the teaching hours/year for educators are calculated as follows:

- Teaching hours/year of preschool teachers = (Teaching hours for children learning 2 sessions/day) x (Working days/week) x (Teaching weeks/academic year).

- Teaching hours/year of principals, vice principals of preschool institutions = (Direct hours participating in educational activities/week of principal, vice principal) x (Teaching weeks/academic year).

- Teaching hours/year of general education teachers; teachers teaching basic vocational levels = [Teaching period standard (standard teaching hours)/week] x (Weeks allocated for teaching and educational activities/academic year).

- Teaching hours/year of principals, vice principals; teachers heading the Young Pioneers Unit; teachers as youth union officials or organizations in general education institutions = (Standard teaching periods/week of principals, vice principals; teachers heading the Young Pioneers Unit; youth union officials, or organizations) x (Weeks allocated for teaching and educational activities/academic year).

- Teaching hours/year of vocational education managers are the minimum teaching hours prescribed at Point b, Clause 3, Section II and Point b, Clause 3, Section III of Circular 09/2008/TT-BLĐTBXH.

The teaching hours/year of managers of intermediate vocational schools are as stipulated in Clause 2, Article 8 of Decision 18/2007/QD-BGDDT.

- The teaching hours/year for other subjects are decided upon by the head of the unit for each academic year.
