National Day - September 2 is a significant holiday for the Vietnamese people. It is also a public holiday according to the Labor Code. Regarding the aforementioned concerns, Lawnet clarifies as follows:
Clause 1, Article 115 of the Labor Code 2012 stipulates that employees are entitled to days off from work with full pay on the following holidays:
a) New Year's Day: 01 day (January 01);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30);
d) International Labor Day: 01 day (May 01);
dd) National Day: 01 day (September 02);
e) Hung Kings' Commemoration Day: 01 day (March 10 of the lunar calendar).
Moreover, Clause 2, Article 115 of the Labor Code 2012 clearly states: Foreign employees working in Vietnam, in addition to the aforementioned holiday entitlements, are granted one traditional New Year holiday of their home country and one National Day of their home country.
Thus, foreign citizens working in Vietnam are subject to the same holiday schedule as Vietnamese employees. Therefore, they are also entitled to a day off on the upcoming National Day like Vietnamese employees.
