Recently, the Ministry of Public Security issued Circular 68/2020/TT-BCA regulating the procedures for patrolling, inspecting, and handling administrative violations by the Waterway Police.
Dealing with violations by operators who do not comply with stop orders (Illustrative Image)
Article 18 Circular 68/2020/TT-BCA prescribes the resolution and handling of violations in cases where the operator does not comply with the order to stop the vehicle during the patrol and control duties of the Waterway Police as follows:
1. Quickly record the characteristics of the vehicle (type of vehicle, registration number, vehicle name, color of paint, and other features); characteristics of the cargo being carried; characteristics of the vehicle operator, persons on the vehicle, and the direction of escape.
2. Report to the unit leader for direction and notify the patrol and control teams on the route, other forces to support and coordinate in prevention.
3. Depending on the type of vehicle and the nature and extent of the operator's violation, the patrol team leader shall decide the organization of forces, means, and measures to implement appropriate interception, ensuring the safety of officers and traffic participants:
- When using patrol vehicles to pursue, ensure the safety between the patrol vehicle and the violating vehicle;- Use the K flag during the day, signal lights at night, combined with loudspeakers to request that the non-compliant vehicle operator immediately stop the vehicle;- In cases where the subject disobeys and uses the vehicle to ram, squeeze the patrol vehicle, or uses means, tools that endanger the lives of officers or show signs of crime, force, weapons, and support tools may be used according to the law to prevent and capture the subject or report to the nearest patrol team, other forces for support and prevention.
4. Handling of non-compliant subjects after capture:
- For administrative violations: Bring the subject, evidence, and violating vehicle to the nearest police station; make a record and resolve the violation in accordance with the law;- For violations with signs of crime: Immediately disarm (if any); bring the subject, evidence, and violating vehicle to the nearest police station; make preliminary records, consolidate materials, evidence, and transfer to the competent authority for resolution.
5. When preventing the actions of a vehicle operator who does not comply with the stop order, if incidents occur causing loss of life, health, property of law enforcement officers or organizations, individuals, or obstructing traffic, the patrol team shall organize the rescue of the victims (if any), prevent further loss, protect the scene, regulate traffic, report to the unit leader for direction, and notify the relevant agencies, units to coordinate resolution according to the law.
