Handling Disciplinary Measures for Militia and Self-Defense Forces if Alcohol is Consumed While on Duty, Misappropriation of Assets

Recently, the Ministry of National Defense issued Circular 75/2020/TT-BQP stipulating the application of disciplinary measures, procedures, statute of limitations, time limits, and jurisdiction for handling discipline for the militia and self-defense forces, effective August 5, 2020.

According to Article 29 of Circular 75/2020/TT-BQP on the application of disciplinary forms, procedures, statutes of limitations, deadlines, and authority to handle disciplinary actions for DQTV, the forms of disciplinary action for consuming alcohol during working hours and intoxication are specified as follows:

- Consuming alcohol during working hours or while performing tasks or being intoxicated, which affects the prestige of the Militia and Self-Defense Force and work results, shall be disciplined by reprimand or warning.

- Violations in any of the following cases shall result in demotion or dismissal:- Disciplinary actions have been taken without recognized improvement, yet violations continue;- Engaging others to participate;- Intoxication while performing tasks;- Intoxication causing public disorder, disunity with the people, resulting in consequences not serious enough.

Furthermore, Article 27 of Circular 75/2020/TT-BQP also specifies the forms of disciplinary action for DQTV who commit any of the following acts of misappropriating assets:

- Taking advantage of position or authority or using other tricks to misappropriate assets of the State, organizations, or individuals valued under 2,000,000 (two million) VND, shall be disciplined from reprimand, warning to demotion.

- Violations in any of the following cases shall result in dismissal to deprivation of Militia and Self-Defense titles:- Engaging others to participate;- Affecting the performance of unit tasks.
