Guidelines for Preparing Cost Estimates to Ensure Road Traffic Safety for Localities

The details of this content are specified in Circular 28/2019/TT-BTC, amending and supplementing certain Articles of Circular 01/2018/TT-BTC on the management and use of funds ensuring traffic order and safety (TTATGT).

Currently, the establishment, allocation, execution, and settlement of funds ensuring traffic order and safety (TTATGT) is carried out in accordance with the provisions of the Law on State Budget and its guiding documents.

Annually, together with the time of establishing the state budget revenue-expenditure estimates; agencies and units assigned the task of ensuring TTATGT shall make the TTATGT cost estimates and compile them into the annual state budget revenue-expenditure estimates of the Ministry, agency, unit, and send them to the same-level financial agency for overall reporting to competent authorities for approval in accordance with regulations.

Clause 5, Article 1 of Circular 28/2019/TT-BTC amended and supplemented Point c, Clause 2, Article 5 of Circular 01/2018/TT-BTC on guidelines for making, allocating, executing, and settling costs to ensure TTATGT for localities. Specifically, the new regulations are as follows:

- The Department of Transport, Provincial Police, centrally affiliated cities, and local Traffic Safety Committees shall make the TTATGT cost estimates according to the assigned tasks and send them to the same-level financial agencies for review, compilation into the annual budget expenditure estimates for reporting to the Provincial People's Committee, to be submitted to the Provincial People's Council as per regulations. Specifically, the Provincial Police, centrally affiliated cities shall make estimates including the costs of ensuring TTATGT tasks for District, Town-level Police, city provinces, and commune-level towns, and send them to local financial agencies, including copies to the Ministry of Public Security for overall management of the police force.

- The Provincial People's Committee shall submit to the People's Council at the same level the decision to use the central budget funds supplemented with specific objectives for the local budget from administrative fine revenues in the field of traffic safety and local budget to perform tasks ensuring TTATGT in the area; specifically, decide the support level for the Provincial Police, centrally affiliated cities to carry out TTATGT ensuring tasks in the area in accordance with Point b, Clause 9, Article 9 of the Law on State Budget; the result of allocation and assignment of estimates for the Provincial Police, centrally affiliated cities shall be concurrently sent to the Ministry of Public Security for overall management of the TTATGT funds of the Public Security sector.

Specifically, for the year 2019, the Provincial People's Council shall proactively use the administrative fine funds on TTATGT supplemented with specific objectives from the central budget to the local budget to perform tasks ensuring TTATGT, prioritizing the police force, Transport Inspectorate and handling black-spot areas with potential traffic accidents as stipulated in Decision 1629/QD-TTg dated November 23, 2018, of the Prime Minister of the Government of Vietnam on assigning the state budget estimates for 2019.

- The allocated funds for the Provincial Police, centrally affiliated cities to perform tasks ensuring TTATGT in the area (including both central budget supplemented with specific objectives, local budget) shall be implemented in the form of estimate withdrawal.

Specifically, for the year 2019, in case the locality has allocated funds to the Provincial Police, centrally affiliated cities by cash order before this Circular takes effect, they shall continue to implement budget spending by cash orders for the allocated estimate in accordance with the regulations. From the effective date of this Circular, the remaining 2019 cost estimates that have not been implemented by cash order shall be implemented in the form of estimate withdrawal.
