Guidelines for Handling Violations Detected During Inspections in the People's Public Security Forces

According to Article 13 of Circular 02/2015/TT-BCA, when conducting administrative inspections in the People's Public Security, if a violation that needs to be handled immediately is discovered, the Chief Inspector or members of the Inspection Team must make a record of the violation as a basis for handling. The handling of violations is carried out in accordance with the provisions of the law on inspection and other relevant laws.

In case a violation with criminal signs is detected, the Chief Inspector must report to the decision-maker of the inspection for review and decision.

In the case that the decision-maker of the inspection decides to transfer the records of the incident with criminal signs to the Investigating Agency, the Chief Inspector shall direct the compilation of records and documents to be transferred to the Investigating Agency. The handover of records of the incident with criminal signs to the Investigating Agency must be documented in writing.

Additionally, Circular 02/2015/TT-BCA stipulates that in cases where the inspection content is complicated, involving the responsibilities of multiple agencies, organizations, or individuals and requires an extension of inspection time, the Chief Inspector must submit a written request to the decision-maker of the inspection for an extension. The request must clearly state the reasons, extension duration, and other opinions from the Inspection Team members regarding the extension request (if any). Based on the Chief Inspector's request, the decision-maker of the inspection will review and decide on the inspection time extension in accordance with the law.
