Circular 38/2016/TT-BGTVT was issued by the Ministry of Transport on December 02, 2016, providing specific guidance on organizing emergency aid for victims of railway traffic accidents.
Circular 38 stipulates that the train master or the driver (if the train does not have a train master) must immediately organize first aid for the injured person. Based on the actual situation, implement the following regulations:
- If the accident location is convenient for taking the victim for emergency treatment by other means of transport, a person must be assigned or urgent mobilization of people and means of transport to bring the victim to the nearest medical facility for emergency treatment;- Organize to bring the victim onto the train or locomotive and transport them to the most convenient station for emergency transfer;- In cases where it is not possible to organize emergency transport as specified in points a and b of this clause, request the relevant agencies, units, and the nearest medical facility to support with means and medicines.
In addition to organizing first aid for the injured and assigning someone to oversee the victim, Circular 38 also stipulates that if there are people on the accident-stricken vehicles who need to be transferred to other carriages or alight to the ground, someone must be assigned to oversee and protect the property (in the case of dangerous goods, safety measures must be implemented).
Note that when there are injured people at the station or on a train handed over to the station, the station master or the train operation officer must organize first aid for the injured.
