Recently, the Ministry of Transport has agreed to issue Circular 32/2014/TT-BGTVT providing guidance on the management, operation, and exploitation of rural transportation roads (RT roads).See Circular 32/2014/TT-BGTVT for more details.
According to the current legal regulations, the entity managing the use of rural roads (GTNT) is a general term for an organization designated by a competent state authority to manage, operate, exploit, and use GTNT roads invested by the state. The investor for GTNT roads not funded by the state; the community for GTNT roads built with contributions from the community or organizations and individuals who contribute capital for construction, management, operation, exploitation, and maintenance.
The identification of the entity managing the use of GTNT roads is guided by Circular 32/2014/TT-BGTVT as follows:
- For GTNT roads invested by the state, the entity managing the use of GTNT roads is determined according to the provincial People's Committee's regulations on assigning and decentralizing responsibilities to the People's Committees at all levels, the Department of Transport, and affiliated agencies regarding the management, operation, and exploitation of GTNT roads in the area.- For GTNT roads contributed by the community or funded by organizations and individuals for construction: The investor is the entity managing the use of GTNT roads.
- In cases where the community or individuals, after completing the investment in constructing GTNT roads, do not have the capability to act as the entity managing the use of GTNT roads, the agency assigned and decentralized as stipulated in point a, clause 1, Article 4 of Circular 32 shall perform the rights and obligations of the entity managing the use of GTNT roads.
- In cases where GTNT roads are built using multiple sources of capital, the contributing parties shall agree on the selection of the entity managing the use of GTNT roads.
