Funeral Expense Regime for Veterans from April 1, 2020

On February 25, 2020, the Ministry of Labor - Invalids and Social Affairs issued Circular 03/2020/TT-BLDTBXH guiding the implementation of some policies regarding Veterans as stipulated in Decree 157/2016/ND-CP dated November 24, 2016, of the Government of Vietnam amending and supplementing Decree 150/2006/ND-CP dated December 12, 2006, detailing and guiding the implementation of certain articles of the Ordinance on Veterans.

According to Circular 03/2020/TT-BLDTBXH, when a veteran passes away, if they are not eligible for funeral expense coverage under the provisions of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution and the Social Insurance Law, the individual organizing the funeral is entitled to funeral expenses at the level prescribed by the current social insurance law.

Regarding the dossiers and procedures for considering funeral expense policies for veterans who have passed away, they shall be implemented similarly to those for individuals with meritorious services to the revolution as stipulated in Article 39 of Circular 05/2013/TT-BLDTBXH dated May 15, 2013, by the Ministry of Labor - Invalids and Social Affairs, which provides guidance on the procedures for dossier creation, dossier management, and the implementation of preferential policies for individuals with meritorious services to the revolution and their relatives.

Additionally, Circular 03/2020/TT-BLDTBXH stipulates that the funding for implementing the policies specified in this Circular is guaranteed by the state budget and allocated in the annual budget estimates of agencies and units according to current budget decentralization. The preparation of estimates, management, use, and settlement of the funds shall comply with the current provisions of the State Budget Law, the Accounting Law, and relevant guiding documents.
