Recently, the Government of Vietnam issued a document on social work in Vietnam. In it, practicing social work for profit is strictly prohibited.

On August 30, 2024, the Government of Vietnam issued Decree 110/2024/ND-CP on social work.

According to Decree 110/2024/ND-CP, social work is an activity supporting individuals, groups, families, and communities to solve social issues.

The subjects of social work are individuals, groups, families, and communities needing social work services (hereinafter referred to as subjects).

Social work functions to support prevention; intervention, therapy; support recovery, and development of subjects to ensure social welfare and build the happiness of the people; contributing to ensuring the implementation of rights, dignity, human values, justice, and social equality according to the provisions of the law.

From October 15, 2024, to prohibit the practice of social work for profit in Vietnam

According to Article 10 of Decree 110/2024/ND-CP, the following acts are strictly prohibited in Vietnam:

- Providing, disclosing, destroying personal information and data of the subjects without the consent of the subject or guardian or representative unless required by competent agencies or individuals according to the law.

- Refusing to provide social work services to subjects needing urgent protection, except in cases of force majeure as prescribed by law.

- Exploiting the provision of social work services for profit or committing illegal acts.

- Exploiting social work practice to profit from the state's policies and support of organizations and individuals.

- Collecting fees, benefits outside of the agreed remuneration and costs with organizations and individuals in the social work service contract, unless otherwise agreed upon by the parties.

- Exploiting social work practice and providing social work services to infringe state interests, and legal rights, and benefits of organizations and individuals.

Rights to practice social work in Vietnam

The rights to practice social work in Vietnam are regulated in Article 21 of Decree 110/2024/ND-CP as follows:

- Practicing social work according to the certification of practice registration.

- Deciding on prevention, intervention, therapy, protection, care, recovery, support development, consultation, assistance, and social work methods according to the certification of practice registration in social work.

- Establishing social work service provision agreements with organizations and individuals in need according to the law.

- Independent social work practitioners are entitled to remuneration according to the agreement. Remuneration is agreed upon in the signed agreement with the subjects based on the principles of correctness and adequacy considering factors including:

+ Content, nature of social work services; the time and effort the social work practitioner spends to execute the social work services;

+ Experience and reputation of the practitioner;

+ Travel, accommodation, and other reasonable costs for providing social work services.

In cases where social work practitioners work at facilities providing social work services, they are entitled to salary, allowances, remuneration, bonuses, and additional income (if any) according to legal regulations.

- Entitled to practice at one or more facilities providing social work services or practice independently.

- Entitled to participate in social-professional organizations regarding social work.
