The Minister of National Defense has just signed and promulgated Circular 182/2019/TT-BQP, stipulating regulations on prisoners meeting with relatives; receiving and sending letters; receiving gifts; and communicating with relatives by telephone.

According to Article 4 of Circular 182/2019/TT-BQP, the following individuals are limited to visit detainees serving their sentences in military prison camps or detention centers: paternal grandparents; maternal grandparents; biological parents; parents-in-law; legal adoptive parents; spouse; biological children, daughters-in-law, sons-in-law, legal adoptive children; biological siblings; siblings-in-law; siblings of spouses; uncles, aunts, paternal and maternal uncles; and biological nephews and nieces. The number of family members visiting detainees is limited to no more than 03 persons per visit.
However, representatives of agencies, organizations, or other individuals besides the aforementioned relatives may visit detainees if deemed appropriate by the head of the detention facility for crime prevention and management, education, and rehabilitation purposes.
Detainees may meet with their relatives as stipulated in Clause 1, Article 52 of the Law on Execution of Criminal Judgments, except those being disciplined under Clause 2, Article 43 of the Law on Execution of Criminal Judgments; detainees under 18 years of age may meet with their relatives as prescribed in Article 76 of the Law on Execution of Criminal Judgments. Detainees who comply well with the detention facility's rules, actively study and work, meet educational and rehabilitation requirements, or to exercise their rights and obligations under the law may have extended visitation times but not exceeding 03 hours or may meet their spouse in a private room not exceeding 24 hours. Detainees who receive commendations or make meritorious achievements may meet their relatives an additional time within the month.
Note: Circular 182/2019/TT-BQP does not apply to:
- Diplomatic visits, consular visits, and contacts with detainees who are foreign nationals;
- Detainees who are being prosecuted, investigated, or tried for other crimes and are held in solitary confinement.
