On December 25, 2019, the Ministry of Science and Technology of Vietnam issued Circular 26/2019/TT-BKHCN detailing the formulation, appraisal and issuance of technical regulations.
From August 1, 2020, periodic review of national technical regulations every 05 year by sector in Vietnam (Illustrative photo)
According to Article 9 of Circular 26/2019/TT-BKHCN stipulates the Ministry, ministerial-level agencies assign the coordinating agency to organize periodic review of national technical regulations every five (05) years by field assigned to be managed by the Government of Vietnam as stipulated in Clause 1, Article 23 of Decree 127/2007/ND-CP, amended and supplemented in Clause 7, Article 1 of Decree 78/2018/ND-CP. The procedures for periodic review of national technical regulations in Vietnam are as follows:
- The coordinating agency prepares a list of national technical regulations due for review as stipulated in Clause 1, Article 35 of the Law on Standards and Technical Regulations 2006.- The coordinating agency conducts the review of national technical regulations according to the criteria stipulated in Clauses 1 and 2, Article 33 of the Law on Standards and Technical Regulations 2006 and other related criteria.- Prepare a list of review results accompanied by an explanatory report, including: the list of national technical regulations to remain in effect; the list of national technical regulations to be amended, supplemented, or replaced; and the list of national technical regulations to be abolished. Within each list, the technical regulations reviewed are prioritized.
The coordinating agency prepares a national technical regulations review dossier to report results and propose plans for amendment, supplementation, replacement, or abolition of national technical regulations to the ministry, ministerial-level agencies for consideration and approval. In case of urgent management needs, the Minister or the Head of the ministerial-level agency decides to organize an earlier than periodic five (05) year review or an ad-hoc review in Vietnam.
