All public employee job titles have regulations regarding training qualifications and professional expertise, including requirements for meeting foreign language and information technology standards. In cases where public employees do not meet the standards for foreign language and information technology proficiency, they may be subject to personnel downsizing.
Based on Point c, Clause 1, Article 6 of Decree 108/2014/ND-CP (amended at Clause 2, Article 1 of Decree 113/2018/ND-CP) stipulating the downsizing of staff, a public employee is subject to downsizing if they do not meet the training standards for the position they are holding, but there is no other suitable position to rearrange, and they cannot be retrained to meet professional and operational standards, or if the agency arranges another job, the individual voluntarily agrees to the downsizing and the directly managing agency or unit consents.
From the above provision, in cases where the unit no longer has another suitable job to arrange, and the public employee does not meet the requirements for foreign language and computer skills according to the professional and operational standards for the current position, they may be subject to downsizing.
The above content applies to officials and public employees on the payroll and commune-level officials receiving salaries from the state budget or the salary fund of the public service provider in accordance with the law.
