Establishments of Production, Business, and Services Must Have the Responsibility to Protect the Environment

This is the highlight content in the Draft of the amended Environmental Protection Law proposed by the National Assembly for public consultation recently.

Article 57 Draft Law on Environmental Protection (amended) mandates that production, business, and service establishments comply with legal regulations on environmental protection and bear the following responsibilities:

- Collect and treat wastewater to meet environmental technical standards; in cases where operations are within industrial clusters, concentrated production, business, and service areas, or within urban areas or densely populated areas with centralized wastewater collection and treatment systems that meet environmental technical standards, the regulations of the investment and management entity of such systems must be followed;- Collect, classify, store, reuse, recycle, and treat waste according to legal regulations;- Minimize, collect, and treat dust and exhaust gases in accordance with legal regulations; ensure that no harmful gases leak or disperse into the environment; limit noise, vibration, lighting, and heat that adversely affect the environment;- Ensure resources and equipment meet the capabilities for preventing and responding to environmental incidents;- Large-scale production facilities in industrial sectors with potential environmental pollution risks must assign dedicated officers for environmental protection who are trained in environmental sciences or relevant fields. These specialized officers must be certified in pollution control as prescribed by the Government of Vietnam; they must have an environmental management system according to ISO 14,000 standards, certified by a conformity assessment organization registered in accordance with the legal regulations on the conditions for conducting conformity assessment services.
