The establishment of the Judicial Expertise Council in the field of agriculture and rural development in Vietnam is stipulated in Circular 49/2014/TT-BNNPTNT, issued on December 23, 2014.

Article 16 of Circular 49/2014/TT-BNNPTNT stipulates the Judicial Expertise Council as follows:
The establishment of the Judicial Expertise Council in the field of agriculture and rural development is carried out in the event of a difference between the initial expertise conclusion and the re-expertise conclusion on the same expertise content and at the request of the examination requester.
The Judicial Expertise Council shall be established by decision of the Minister of Agriculture and Rural Development to conduct the second re-expertise.
Establishing the Judicial Expertise Council:
- The Legal Department shall preside and cooperate with the Personnel Organization Department to select judicial experts, case-specific judicial experts, and officials of the Ministry with high expertise appropriate to the content of the expertise request, who are not the judicial experts who conducted the initial expertise; complete the dossier for the Minister's decision to establish the Council;
- The Judicial Expertise Council consists of at least 03 members who have high expertise and reputation in the field requiring expertise. The Judicial Expertise Council operates under the collective expertise mechanism stipulated in Clause 3, Article 28 of the Law on Judicial Expertise.
