Electronic Archiving Activities of Journalistic Works

Electronic depository activities refer to the central state management agency for press organizing the receipt, storage, preservation, and usage of spoken press, visual press, and electronic press works. Electronic depository activities are regulated as follows:

1. Receiving Journalistic Works for Electronic Archiving

According to Decree 08/2017, the head of the agency conducting electronic archiving is responsible for organizing the receipt of radio, television, and electronic journalistic works for electronic archiving.

The receipt of radio, television, and electronic journalistic works shall be carried out according to the following procedure:

- The agency conducting electronic archiving shall issue a notice to the radio, television, and electronic news agencies to connect in accordance with Clause 2, Article 5 of this Decree.

The notice shall specify the connection plan, signal transmission method (for radio and television), connection and retrieval plan of journalistic works posted on the electronic news site (for electronic news) to the electronic archiving system of the archiving agency; time and place for connection execution.- No later than 10 working days from the date of receiving the notice on the connection plan, the radio, television, and electronic news agencies must issue a written reply, agreeing on the connection with the electronic archiving agency.- After connection, the electronic archiving agency shall check and ensure that the works have been stored in the system and confirm with the news agencies within 15 working days from the date of receiving the journalistic works.- The electronic archiving agency shall organize and preserve the original content of the journalistic works in the archiving system; classify content to serve management tasks.

2. Preservation of Electronically Archived Journalistic Works

- For radio and television, the minimum preservation period of the original content is 6 months from the first broadcast date.- For electronic news, the minimum preservation period of the original content is 12 months from the first posting date.

3. Preservation of Electronically Archived Journalistic Works

- Works in the electronic archiving system must be safely preserved and maintain the original information content.- The electronic archiving agency must regularly check to ensure safety, integrity, and retrievability, and utilize technical measures to facilitate classification and preservation without altering the content of the works.- The electronic archiving agency shall develop solutions to ensure technical quality and information safety for the electronic archiving system.

4. Utilization of Electronically Archived Journalistic Works

- Electronically archived journalistic works shall be used for state management purposes in journalism, including: Evaluating and commenting on information content according to topics, events, for regular and ad-hoc specialized inspections as required.- The electronic archiving agency is entitled to use electronically archived journalistic works as a basis for handling cases where the content of the works is found to be in violation.
