Duties and powers in law making in military agencies in Vietnam

Recently, the Ministry of National Defense has issued Circular 79/2013/TT-BQP stipulating the functions, duties, powers, organizational structure, and working relationships of legal sections and legal officers in the military in Vietnam

Clause 1 Article 19 Circular 79/2013/TT-BQP stipulates the tasks and authorities of legal sections and legal officers in agencies and units within the army regarding law making work as follows:

- Compile, propose, preside, and coordinate in organizing the implementation of the program and plan for the construction of legal normative documents and internal normative documents under sectors managed by the agency or unit; submit them to the head of the agency or unit for consideration and decision, send to the Legal Department for aggregation; monitor, urge, inspect, and report the implementation of the program and plan for constructing legal normative documents and internal normative documents within the unit.

- Preside and cooperate with relevant units in monitoring, urging, inspecting, and drafting projects and drafts of legal normative documents and internal normative documents under sectors managed by the agency or unit as assigned by the head of the agency or unit.

- Participate in commenting on projects and drafts of legal normative documents and internal normative documents sent for comments as assigned by the head of the agency or unit.

- Preside and cooperate with drafting units in preparing the dossier of the draft legal normative documents and internal normative documents; submit to the head of the agency or unit for decision-making on soliciting opinions from agencies, organizations, individuals, or propose competent authorities for appraisal and evaluation; revise and finalize the draft documents.

Furthermore, this Circular stipulates tasks and authorities in monitoring the implementation of the law in Vietnam:

  1. Preside over assisting the commanders of agencies and units to cooperate with the Legal Department in guiding, monitoring, urging the execution of legal implementation monitoring work, and inspecting the implementation of laws related to the sectors managed.
  2. Preside and cooperate with relevant agencies and units to compile and construct reports on monitoring the implementation of the law and inspecting the law's implementation related to the sectors managed, and send to the Legal Department for aggregation.

More details can be found in Circular 79/2013/TT-BQP, which comes into effect in Vietnam from August 14, 2013.
