Duration of Probation for Public Employee's Professional Title

This is a notable provision stipulated in Circular 28/2016/TT-BTNMT prescribing the probation period according to professional titles for public employees specialized in natural resources and environment, issued by the Ministry of Natural Resources and Environment on October 06, 2016.

To be specific, Circular 28/2016/TT-BTNMT stipulates the probationary period for job titles within the public employee category in the natural resources and environment sector as follows:

- In order to be appointed to the job title of a public employee in the natural resources and environment sector of rank IV, the successful candidate must complete a 6-month probationary period.- In order to be appointed to the job title of a public employee in the natural resources and environment sector of rank III, the successful candidate must complete a 12-month probationary period.

In addition, Circular 28 also provides specific regulations for special cases concerning the probationary period as follows:

- A successful candidate for the job title of a public employee in the natural resources and environment sector of rank IV or rank III, who has performed professional work relevant to the demands of the job position being recruited and has paid mandatory social insurance for 12 months or more, will be exempted from the probationary period.- The period of maternity leave under social insurance benefits; the period of sick leave that lasts for 03 or more consecutive working days; the period of temporary detention, custody, or suspension from work in accordance with the law for the successful candidate will not be counted towards the probationary period. The probationary period will resume immediately after the successful candidate completes their maternity leave under social insurance benefits; completes their sick leave; or completes the period of temporary detention, custody, or suspension from work in accordance with the competent authority's regulations.
